| Oak Park's gun ban to go before Supreme Court October 8, 2009 Oak Park's gun ban to go before Supreme Court :: News :: PIONEER PRESS :: Oak Park Leaves With the U.S. Supreme Court's decision last week to hear a challenge to Chicago's and Oak Park's handgun ban, the village attorney is weighing his options on how Oak Park should proceed. Oak Park Village Attorney Ray Heise, who wrote the handgun ban ordinance 25 years ago, is keeping a watchful eye over the challenge by gun rights activists of its constitutionality. But the fact that the Supreme Court decided to hear the Chicago case, over two other similar cases, changes Oak Park's strategy. "In terms of the appeal process, we now have choices rather than obligations," Heise said. "Our case, for all intents and purposes, is complete. The seventh circuit dismissed the NRA lawsuit against the village and the Supreme Court did not accept that case on review." But Oak Park will still be subject to the outcome of the High Court's decision, he said. "The village needs to decide how it wants to proceed from this point forward," Heise said. "Do we assist Chicago in their preparation for the Supreme Court hearing on this case? Do we file an independent amicus brief in support of the city? Do we join others in an amicus brief? There are lots of choices. The village is, as the only other municipality with a surviving handgun ban, in a unique position, so it is going to have to consider that when it decides how it wants to proceed." But that decision is not necessarily urgent. "The Supreme Court case is going to come up on their docket well into 2010, so there's time to think about this," Heise said. The case in question, McDonald vs. Chicago, was filed last year and the 7th U.S. Circuit Court of Appeals upheld Chicago's and Oak Park's ordinances. The plaintiff in that case, backed by the National Rifle Association, appealed to the Supreme Court. The Chicago-based law firm Mayer Brown agreed this summer to represent Oak Park on a pro bono basis. Heise said the firm will continue to represent the village at no cost. "The first thing I've asked Mayer Brown to do is to summarize the village's options, and I also asked them to make a recommendation, so I want to see that first before I weigh in on it," Heise said. The crux of the issue, and how it differs from an across-the-board ban on guns in Washington D.C., which was ruled unconstitutional last year, is that Oak Park's ban only applies to handguns. Just like in Chicago, Oak Park's law allows residents to own rifles and shotguns. That, Heise would argue, means an Oak Parker's fundamental constitutional rights are still in tact. "The right to self-defense and weapons to defend one's home may be fundamental, but the right to carry a particular kind of weapon is not," he said. "That's going to be the critical issue here." Another crux is whether state and local governments have a right to interpret the federal law and apply it based on its unique circumstances, he said. "Does the City of Chicago and Village of Oak Park, which exist in an urban environment, have the ability to react to gang violence in a unique way, whereas a rural community can enact legislation to protect its citizenry in a totally different way?" Heise asked, rhetorically. Handguns are the "weapons of choice" among street criminals, he added. That's why the law singles those weapons out. "We did a little internal piece about armed robberies, just taking a look at armed robberies with the use of handguns, and this was through the first seven months of this year, there were 28 robberies using handguns and none using rifles or shotguns," Heise said.
