Out-of-state concealed carry recognition fails in U.S. Senate


(July 22, 2009) The U.S. Senate came two votes short of passing a concealed carry reciprocity provision introduced by Republican Senators John Thune (SD) and David Vitter (R-LA). The language would have allowed people who are authorized to carry in their home states to carry their firearms in other states, as well. Even though the Thune amendment garnered more than a majority (58-39), a parliamentary maneuver required 60 votes to pass the measure.

The Heller decision affirmed that the Second Amendment protects an individual right to keep and bear arms. The Thune/Vitter amendment will simply protect the right of citizens to carry firearms outside of their home state without violating the rights of the other states. Thus, the reciprocity language protects the principle of federalism while also protecting the Second Amendment rights of America’s lawful gun owners.

I personally think its dumb that the majority voted for it, however it still didn't pass. Something wrong here imho

Up untill this vote I had high hopes for George Voinovich, maybe I was wrong.

Yesterday the Senate fell two votes short of the 60 needed to pass an amendment to the Defense Authorization bill that would have allowed people with concealed carry permits in their states to carry guns in all other states that have concealed carry laws. Fifty-eight senators, including Majority Leader Harry Reid (D-Nevada), supported the amendment; 39 voted against, including Republicans Dick Lugar (Indiana) and George Voinovich (Ohio). (See roll call vote)

Donny Ferguson, communications director for the Libertarian National Committee, says he is troubled that 39 senators believe Americans' constitutional rights end at the state line.

"Your freedom to worship doesn't vary from state to state, your freedom to speak freely doesn't vary from state to state, your freedom to be free of unreasonable search and seizure is universal -- so why not gun rights?" he asks.

"It's very simple -- and especially since the people often targeted by criminals are truckers and travelers, it just seems like it would be common sense for states to honor one another's concealed carry permits."

Ferguson predicts voters will throw politicians out of office for voting against their gun rights. He points out that Harris Wofford of Pennsylvania lost his Senate reelection bid in 1994 because of his support for the assault weapons ban.

Are those against nationwide concealed carry for states' rights?

As we saw yesterday, the Thune amendment for nationwide concealed carry reciprocity has failed to pass in the Senate. What are the antis saying?

Paul Helmke of the Brady Campaign:

This proposal would have let people from states with the weakest gun laws in the nation carry hidden, loaded weapons in states with much stronger gun laws.

The Los Angeles Times:

The Senate refused to weaken states' rights in enforcing their own concealed-weapons laws...

Sen. Richard Durbin:

The states already have laws. Under the Thune amendment, those laws could be ignored.

You get the picture.

But isn't that consistent with what Barack Obama has said?

"I know that what works in Chicago may not work in Cheyenne."

I guess that depends on when he said it. For instance, if we go back to his National Public Radio interview in 2004, he...well, why not listen for yourself?

A federal ban on concealed carry. From Chicago to Cheyenne. That's some respect for "states' rights" and "state gun laws."

But the good thing about being Obama is that your position can evolve over time--at least when it serves your purposes, and your "Authorized Journalist" publicity team helps you get away with it.

For instance, let's take a look at Obama's position on nationwide concealed carry as reported by CNN...

...in December 2007, when the Democrat field was wide open:

...in April 2008, when the challenge from Hillary Clinton was strong:

Consistent, wasn't he, when he had to appeal to a gun control-supporting constituency?

Now let's look at the page as it still exists, reflecting when Obama's sole obstacle was John McCain, and appearances of being "moderate" served his purpose...

What? Nothing about concealed carry? Nothing about one gun a month? Lip service for the Second Amendment being "an individual right"?

Ah, here's something about states' rights:

But just because you have an individual right does not mean that the state or local government can't constrain the exercise of that right.

So if their laws work for gun control, states have rights. But if state laws work against gun control, federal bans are in order--from Chicago to Cheyenne. Just moderate the message in accordance with political needs. Supporters in the media will help cover tracks.

And the new "common knowledge" is that there is no threat to gun owners, and you're paranoid and reactionary for thinking there ever was.
