You've probably seen the news in your state. But in case you missed it, several media outlets are reporting that Republican Senator Lindsey Graham is "open to voting for" President Obama's anti-gun pick for the U.S. Supreme Court.

This is outrageous. Not only is Sotomayor EXTREMELY anti-gun, she has expressed racist views in multiple speeches over the years and she has proven -- in her actions and words -- that she is committed to IGNORING THE CONSTITUTION!

Why should a Republican Senator be announcing his support for this judge?

It is imperative that you contact your Senator right away. There are three main reasons why he should oppose Judge Sonia Sotomayor:

1. Anti-gun Judicial Record. Judge Sotomayor has held that there is "not a fundamental right" to keep and bear arms and that the Second Amendment -- whatever little it protects in her estimation -- does not apply to the states, only in Washington, DC.

2. Inability to Support Self-defense. When asked during the Senatorial hearings if she favored the right of self-defense, Sonia Sotomayor stated that such a proposition was an "abstract question" and that she couldn't think of a Supreme Court case that addressed that issue. (Hmm, Sonia, doesn't the Second Amendment address the issue?)

3. Misled Congress in Regard to Following the Law. Judge Sotomayor repeatedly told Senators that she would follow statutory law and existing precedents. But she's already failed to do that during her judicial career. Sotomayor has been overturned on numerous occasions
(6) by the Supreme Court and has been rebuked by both the Supreme Court and by appellate judges for not following precedents and statutes.

So does anyone really think that she will be a stickler for precedent if she is confirmed to the high Court? Never mind the fact that in her rulings and in her statements, she has ignored a very important "precedent" -- the common understanding in this country for 150 years -- that the Second Amendment protects an individual right.

At a time when President Obama is trying to shove socialism down our throats, we can't afford to have another anti-gun, anti-constitution judge on the U.S. Supreme Court.

It doesn't matter if you are a Republican, Democrat or Independent... or are liberal or conservative. You need to contact your Senator today and urge your family and friends to do the same.

Saw that yesterday and sent him a nasty-gram. I asked him point blank how he could vote for the National Carry bill (that failed yesterday) and support Sotomayor at the same time! I called him self-contradictory and demanded that he call me, not send a generic letter, explaining why he's being two-faced. I then told him that he has a few weeks to change his mind (before the vote is called) otherwise I will vote for a democrat over placing him back in the senate seat. I hope the NRA comes down hard on his butt!

When I wrote him I stated that I was going to do everything I could to get him dumped in the next election. I said I was going to dedicate all my time and as much money that I could to whomever ran against him!

A Committee vote on the nomination of Judge Sonia Sotomayor to be an Associate Justice of the United States Supreme Court will be held on Tuesday, July 28, at 10:00 a.m. in room 216 of the Hart Senate Office Building. The meeting will be webcast live online.

You and I know that it is extremely important that a Supreme Court justice understand and appreciate the origin and meaning of the Second Amendment, a constitutional guarantee permanently enshrined in the Bill of Rights. The record of Barack Obama's Supreme Court nominee, Judge Sonia Sotomayor, on the Second Amendment should cause every patriotic American grave concern over her treatment of this enumerated constitutional right.



Last year, the Supreme Court decided the landmark case District of Columbia v. Heller, holding that the Second Amendment guarantees to all law-abiding, responsible citizens the individual right to keep and bear arms, particularly for self-defense. Following Heller, the Supreme Court is almost certain to decide next year whether the Second Amendment applies to states and local governments, as it does to the federal government (see NRA v. Chicago and McDonald v. Chicago.)
While sitting as a federal judge on the Second Circuit Appeals Court, Judge Sotomayor revealed her views on the right to keep and bear arms in Maloney v. Cuomo, a case decided after Heller, yet holding that the Second Amendment is NOT a fundamental right, that it does NOT apply to the states, and that if an object is "designed primarily as a weapon" then that is a sufficient basis for total prohibition -- even within the home!
Earlier, in a 2004 case, United States v. Sanchez-Villar, Sotomayor and two colleagues perfunctorily dismissed a Second Amendment claim, holding that "the right to possess a gun is clearly not a fundamental right." Imagine if such a view were expressed about other fundamental rights guaranteed by the Bill of Rights, such as the First, Fourth and Fifth Amendments!

Surprisingly, Heller was a 5-4 decision, with some justices arguing that the Second Amendment does not apply to private citizens or that if it does, even a total gun ban could be upheld if a "legitimate governmental interest" could be found. The dissenting justices also found D.C.'s absolute ban on handguns within the home to be a "reasonable" restriction. If this had been the majority view, then ANY gun ban could be upheld, and the Second Amendment would be meaningless!
The Second Amendment survives today by a single vote in the Supreme Court. Both its application to the states AND whether there will be a meaningfully strict standard of review remain to be decided by the High Court. Judge Sotomayor has already revealed her views on these issues -- and they are obviously contrary to the intent and purposes of the Second Amendment and Bill of Rights. As supporters of the Second Amendment who are deeply concerned about preserving all fundamental rights for current and future generations of Americans, we need to strongly oppose this nominee, and URGE the Senate NOT to confirm Judge Sonia Sotomayor -- NOW. Like all other threats against our freedoms, we must rise and defeat this nomination -- slap it down hard.
