    Default 45 Days

    So In Wisconsin the DOJ law says that they have to issue you a permit or denial within 45 days. What happens if you havent recieved your cc permit within the 45 days? Such as the case in my situation. I fully studied the DOJ website FAQ and this situation is not covered. Anybody have an answer for me. I mailed my application the morning of Nov. 1st so they should of gotten my packet by Nov. 3rd at the latest. Thank and thanks for the great forum

    Unfortunately the law didn't stipulate what happens after the deadline. Some States have it in the law that they have X amount of days to issue or deny and if they fail to do so the applicant is considered licensed until the permit or denial comes thru. Wisconsin chose not put the remedy in the law itself.

    Things I can suggest is to call the DOJ and ask why your permit wasn't issued. Maybee if it is lost you could resubmit and get it put at the top of the list.

    If that doesn't work you could try and use the emergency licensing provisions of the law. I dont think a judge would hesitate to give you an emergency license being that you applied and they have not issued you a regular one in the allotted time. The temp one should last long enough for them to finish all first month apps.

    And last you could talk to a lawyer and see what legal options you have. I would bet that a lawyer would get them to find your app and process it immediately instead of going thru legal hassles. But of course this option would cost you money.

    PS In the Wisconsin forum when I made suggestions about how to handle not getting the permit, the poster I was responding to got it the very next day. Happened twice so far and hopefully will happen a third for you.

    They are probably running behind with the huge amount of permits they are trying to process on this initial round and it will settle down after this. The 45 days is covering during normal processing conditions, not this initial surge. Also, it's Christmas time, everything is slower.

    Hopefully its in the mail and just makeup do to the time year. I mailed mine in on the 1st and just received it a few days ago.

    I have a feeling you guys are correct when you mention the mail being backed up because of the holiday. Not that I need it in a hurry, just one less thing to wonder about. Thank you all on this forum, I've learned a lot from your conversaytions. MERRY CHRISTMAS

    Actually the 45 days was for the initial surge, the normal processing time in the law is actually 21 days.
