    Default A bit confused on NYC's gun laws.

    I have a NYS CCW as I am a resident of Ulster County. I have to travel over the next few weeks onto Long Island. My quandary is am I allowed to possess my weapon albeit in a locked safe in the trunk separate from the ammo? Reason why I ask is because I desire no problems in Bloombergville.

    I hope this helps but I saw this on the New York State Carry Permit Application...........

    "NO LICENSE ISSUED AS A RESULT OF THIS APPLICATION IS VALID IN THE CITY OF NEW YORK."

    Seems to me that if it's locked in your trunk your still illegal. And the fact that it's locked in your trunk does you no good if you need it anyway. Plus, then, the guy that steals your car while your in your hotel, restaurant, or massage parlor also ends up with your gun.

    What part of Long Island? The parts in Nassau and Suffolk are not in NYC

    In addition, if you are in one of the burbs of NYC on the island. I see that Penal Code 400 states this..........

    6. License: validity. Any license issued pursuant to this section
    shall be valid notwithstanding the provisions of any local law or
    ordinance. No license shall be transferable to any other person or
    premises. A license to carry or possess a pistol or revolver, not
    otherwise limited as to place or time of possession, shall be effective
    throughout the state, except that the same shall not be valid within the
    city of New York unless a special permit granting validity is issued by
    the police commissioner of that city.

    As a former Dutchess County resident (but still do business in NYS), I'm thinking do exactly as you're intending to do as you drive through NYC. This is a case where the NYS transport rules for non-licensed persons can be in effect... as in drive on through with no stops (including for gas) in the 5 boroughs, and if you don't get yourself pulled over I can't see why anyone would need to know what's in your trunk. Besides, if you did just be cordial if the subject comes up and let the nice officer know what your destination is... you're definitely not the first person to be in this situation.

    Man. New York city is so F'ed up. Funny how new York was excluded as if they are their own state.

    Maybe I should clarify this. My intention is to drive through the Bronx and Queens making my way to Long Island only. I am legal to carry concealed in NYS , and am legal to carry in Nassau and Suffolk counties. applying federal law I believe as long as I transport my weapon locked in a safe in trunk separate from ammo then it would be the same as carrying from one state you are legal and to another. I hope a NYC LEO or an attorney can shed some light.

    Of course coming from where you could drive through Connecticut to Bridgeport and take the ferry to Port Jefferson. Then you can have your weapon locked up in your trunk through Conn. and totally avoid the city and Queens.
    Didn't really help did I? Just goes to show how screwed up things are in Bloomberg Appleton!

    I suggest you go the long way or at least another way. If an NYC cop finds out that you have a gun you better have your tooth brush with you cuz' you ain't going home for awhile. Every year hundreds of people get arrested for having an unlicensed gun in NYC. Your choices are to don't go, go another way, leave the gun at home, or roll the dice. If you decide to chance NYC don't have a breakdown. Certainly don't get in an accident with that fool texting at 65mph.

    You should be able to take your gun where ever you wish. Unfortunately, that is not the way it works. Your state legislature can fix that. You may want to consider whether you are more likely to get killed without your gun for a few days or in jail for a few years. There is one other option, you can ship it to yourself via FedEx or UPS. Hope there is something here that helped. Good luck.

    BC1 can shed some light on this. Look up his member info and PM him. From my understanding you have to notify the NYPD (not sure exactly who or where) and let them know your itinerary and travel information regarding your situation with your firearm and that you will be traveling through to get to another destination that is outside the city. It is pathetic and screwed up, but I believe that there is a specific protocol to do it. Good luck and let us know how you make out.
