Not a good move to do so. Assuming they were running away and posed no apparent threat of immediate bodily injury or death, you would, in my opinion, not be justified to use lethal force. While they were running away with their backs facing you, I see no problem drawing your weapon to be on the ready if they made a move to turn around and offer additional violence with their weapon. However, leave the shooting of a fleeing felon to law enforcement who may use lethal force under certain circumstances when trying to stop/apprehend fleeing felons who may pose a threat to the community.

Agree with ya JAG but in my reality and they were walking away from me....... I would draw, YELL FREEZE!!! and let the situation play out from there. I'll execute a controlled take down either by their submission or by discharge of my firearm. Their choice.
