The "Gun Show Loophole" from New York to your State

In NY can you do a private handgun sale without a FFL? If you can, how do you get it listed on your permit? Doesn't the seller have to have it removed from his? And then onto yours? Just seems like a hassle for sure. Being that I am from NY and if the opportunity comes up, what do I need to do to do a private sale?

I would say move! I'm so glad I don't live in that area anymore. My folks took us to Florida when I was 16 and when I retired I just stayed in SC where I already owned a home.

I feel for you but you may want to read the law and not depend on an answer from this or any other forum.

There is a guy here who actually puts on classes up in NY and helps you get a permit but his name escapes me right now. He would be one of the only answers I would trust on this site about that particular question, and then I would still see if it matched what the actual law says.

BC1 is also a good source and he can tell you where to find it in writing.

Seems that the standard answer when people don't have one is MOVE. BC1 has been very helpful in answering many questions from many people without the standard MOVE and I and I am sure many other people appreciate it also. Don't get me wrong, I had 30 acres in Pickens cty and loved it but I'm not able to provide for my family the way I can here in N.Y. in my industry down there. So if you know where I can make what I make here down there let me know. Already have my permit and a few handguns but thought maybe the answer would be easier here. Believe me I would check it with either L.E. or a FFL before doing anything.

Why isn't Bloomberg in prison yet. He has directed straw purchases with city money. On CBS2 tonight he said that the gun used was an illegal Ruger P-95 9-mm. Only in a place like NYC would it be so. And he pointed out that a NY judge had let the killer go free. Yep, a liberal judge I'd bet. Weak on criminals, strong on law abiding citizens.

Yes, you can do a private handgun sale in NY state without an FFL. The easiest way is for the original owner and the buyer to go to the county pistol office (or whoever handles pistol licenses in your county) and do the transfer. There is a small charge for removing the pistol from the seller's license and adding it to the buyer's. I suggest you call the license office in your county for all the details.
