A Calgary man has been sentenced to six months in jail for failing to report a registered handgun was stolen from his home nearly three years ago. The weapon was later used in a crime.
Provincial court Judge Barbara Veldhuis said she found Anthony William Beare's explanation for not telling anyone the 9-mm firearm was taken in a break-in "defied logic."
Defense lawyer Michael Bates had said his client, who worked at the Shooters Edge firing range at the time, was reluctant to say anything for fear he'd lose his job.
"You have all the paperwork, there is no harm in having weapons, they are all properly stored," said Veldhuis. "By that extent of logic, there is no reason why you shouldn't report someone breaking and entering your apartment . . . no reason not to pick up the phone."
Veldhuis said the greatest concern with lost or stolen weapons not being reported is they are often used in criminal offenses and police are unaware they are on the street.
The judge made the sentence consecutive to a five-year prison term and lifetime firearms prohibition meted out to Beare, 31, last summer.
He had pleaded guilty then to 14 charges stemming from a cache of illegal guns, homemade pipe bombs, ammunition and drugs found inside his rented De Winton home during a raid in December 2008.
Crown prosecutor Shane Parker said the rarely used section of the Criminal Code for not reporting lost or stolen firearms called out for a significant sentence because of the fear such a weapon might be used in a crime -- and in this case it was.
He said the gun was used by an unknown culprit to shoot Mohamed Habib outside a video store in the 1200 block of 17th Avenue S.W. on Sept. 28, 2007.
The perpetrator shot Habib once in the forearm, then fled to a parkade, where he carjacked a vehicle and drove away. The handgun was found discarded nearby. Despite its serial numbers being filed off, investigators were able to trace the weapon back to Beare.
Another judge will decide Nov. 1 whether Beare is guilty of aggravated assault in the stabbing of a fellow inmate at the Calgary Remand Centre on March 28, 2009.
Shaun Alexander Folk, 33, testified last week he was stabbed by Beare as part of a grudge.
