    Gun industry goes on trial in appellate court today

    Danny "Bud" Williams, then a 16-year-old basketball phenom, was shot nine years outside his Buffalo home while playing basketball, an innocent victim of gun violence.

    Today, Williams, 25, is out of school and working - but he never attained his dream of playing Division 1 college basketball.

    The man who shot Williams, Cornell Caldwell, served his sentence, and was released from prison earlier this year.

    The gun trafficker who sold the 9mm handgun used in the shooting, James Nigel Bostic, also served his time and been released from prison.

    Still on trial, however, is the gun industry.

    The New York Appellate Court in Rochester today is scheduled to hear arguments addressing why the manufacturer, distributor and dealer of the gun used to shoot Williams should or should not be held liable for the serious wound Williams suffered in 2003.
    So far, the courts have sided with the gun industry.

    So, can people sue the car makers and dealers when they're injured or killed by bad/drunk drivers?

    I think I'm gonna sue the Jack Daniels because of all the hangovers I used to suffer when people bought me shots.

    Springfield Massachusetts or Hartfield Connecticut are lots better places to have your weapons factory than anywhere in NY. At least that's what Smith&Wesson and Colt have determined.

    Remington Arms is in NY and I guess that is why they do not dare make military style battle firearms. And Weatherby is in Paso Robles Calif.

    Eagleeyes did not give us much to go on about make and calibre, although in the case of a military style battle rifle, the retailing question seems valid enough. If only an ordinary handgun, rather than an uzi or mac-10, then the lawsuit will likely be determined as frivilous.

    Anybody can sue anyone for anything. As long as they want to throw lawyers' fees against someone banking on a settlement, the game is fair.

    The issue is not about whom we may sue, it is about what, at this time, place and Polling status, the politically correct and politically incorrect is. Getting drunk on alcohol is acceptable; killing babies with only their head in the mother is acceptable. Guns are evil; they cause death and destruction by just being in existence. Soon it shall not be politically correct to be incorrect.

    I am so amazed sometimes at how these things even make it to trial. It is truly an open and shut case. The manufactures did not sell the gun to the shooter and they did not shoot Danny Williams. The crime was done by two individuals who served their time. Let it go. Do not punish those for the acts of others.
