    Richard T Farrell, the author of Richardson on Evidence, one of the best known and respected books on New York evidence, is know for his saying that more people are convicted with the evidence obtained immediately after the suspect says "but office, let me explain...." than any other source.

    There are really two reasons you should never speak to an LEO investigating you without a lawyer. first is that the LEO is looking for evidence to be used against you. He or she is not concerned with collecting exculpatory evidence.

    Second is that you need a second set of credible ears to assess what the LEO's say and to accurately record anything you might say.

    Sorry to hear this. I don't trust LE enough to ever have a conversation with them. A LEO recently hassled my wife for parking crooked within the lines at a supermarket. He inferred she was DUI. She refused to talk with him. He then wanted to search the car. Although there was nothing in the car she refused and locked it. He wanted to know what meds she was taking. She refused to talk to him. He told her she was required by law to tell him. She continued to refuse to talk. He went to his car and she called me. I arrived at the scene with an attorney friend who immediately stopped him. She had recorded him on her cell phone and he didn't know it. He denied advising her she had to talk. He made her do a drunk test without her crutches as she was badly injured in an auto accident and had just had her third surgery and is now permanently disabled/crippled. She had broken verts in neck & back, broken ribs and a torn rotator cuff. She played back the conversation right on the spot. He was steamed but hey, he was SNAGGED! Attorney took him aside and spoke with him. He apologized to her and went on his way.

    Later I asked my friend what he said to the LEO. He told him to arrest her and charge her with DUI. There would be a blood draw and it will come back negative for drugs or alcohol as she doesn't drink or do drugs of any kind. She would then file charges of civil rights violations and discrimination against the handicapped. He would be filing a summons and complaint in fed court seeking damages from the town, PD and officer.
