Montana Codes Annotated states in 46-5-401 that an officer must suspect a crime either Has Been Committed, Is being Committed or Will Be Committed in order to perform a stop on any citizen. If none of these criteria can be met, then the stop is unjustified and unnecessary and by rights, should not continue!
I know this may sound cruel and not nice at the same time, but I make it a point of recording all Traffic Encounters with Law Enforcement on a Digital Voice Recorder. I figure, if the cop is recording Video and Audio in his vehicle, I'm allowed (As long as I inform them) to record it as well!! They don't like that. Some have told me to turn it off, others have gone about the stop without so much as skipping a beat!!
