    Default Full Unrestricted Carry in Chemung...

    How likely or unlikely is it for me to get a unrestricted carry.

    I have a job
    25 years old
    5 years of recent Active Duty service in the Army. Afghanistan Vet.
    Current National Guard member
    Clean Record all around, and a security clearance.


    On my letter to the judge, I would explain to him that I have countless hours of weapons training, previous exp being responsible for the saftey and handling of weapons in a warzone. I want a concealed carry, for protection. With the number of shootings and violence against members of the armed forces, I want to exercise my 2nd amendment right (which I defended and still defend) and be the provider of my own personal protection if needed.

    Where is Chemung and what are the laws concerning Open Carry or concealed carry? That is the first place I would tell you to look. Good luck.

    Obtaining NY unrestricted permits sometimes requires patience, depending on where you live. At 25 years old some judges might grant only a restricted permit until they feel comfortable with you. Others will want to see cause before issueing an unrestricted carry out of the gate. The U.S. district court recently handed down a decision that stated that personal protection did not justify cause (in any state). For those that think their state is above this, they're one election from it... THIS WAS A FEDERAL COURT DECISION, NOT A NY COURT DECISION. We've been doing permit services for many years and find the best approach is to stay completely away from self-defense as a reason. Stay away from violence against the military or any concern over it. Your right to self defense is provided for in Article 35 of the NYS Penal Law. I've never seen a permit issued specifically for self-defense. Avoid these topics completely during your interview.

    The best approach is to request the initial permit for hunting, fishing, camping, hiking, target, mountain biking, while carrying sums of money and all lawful purposes. Then request it be unrestricted to avoid any unintentional violations of restritions.

    Regardless of your weapons training I would suggest eventually taking a course in concealed carry/personal protection after you get your permit. This covers civilian carry, proper equipment, the law and strategies for avoidance, deterrence and de-escalation. If the inital permit has restrictions they will be broad and will provide a wide berth to you. I would still request the initial permit be unrestriced as some counties will issue it to everyone.

    You need to visit your local county clerk's office. Every county in NY has different rules concerning CC permits.

    It all really depends on the judge in Chemung County. The judge in Madison County believes in "no restrictions" while Onondaga, Oneida, Herkimer not so much. I agree with the sentiment above, it's never about self defense but hiking, target, hunting and camping. Heck, walking the dog around the block is "hiking" in my mind.     I would suggest that "countless hours of weapons training" via the military may not be to your advantage when writing your letter. NY State, and many judges do not "count" your military training, and when discussed with members of the offices of NYSDCJS and some judges, the reason for that is that the laws of NY, and rules of engagement are vastly different as a civilian.

    Your age may be a problem, although your service to our country is appreciated and shows you are a responsible young man.

    I agree with what some posters said, Chemung is a more carry conceal friendly county then others. Good luck

    Default chemung concealed carry

    I just got my ccw in chemung,city of Elmira.I got mine by showing that I had a reason to carry via job related.If you can't show that you have proper cause to carry you will be denied.

    Follow BC1's advice. Or better yet, hire him or someone like him to guide you through the process to increase your chances.

    But whatever you do, don't mention "neighborhood watch" in your application.
