I'm glad that the Heller decision was useful in this case, however the man should be punished. There's no excuse for leaving a firearm where it could be accessed by a minor.Had the 12 year old loaded the handgun with the full magazine (that was in the same drawer), the results would have been a lot different. I would seriously consider this guy's fitness to be a LEO. Sound judgment is a MUST for folks responsible in "keeping the peace".

I agree that the LEO should've been more responsible. He also should have schooled the young boy in gun safety and this incident may have never occurred in the first place. If your firearm is not under your direct control, then it shold be locked away. Even in MA, "under your direct control" allows you to keep it unlocked in your bedside night stand. That is considered under your control. But you can't just leave it like that. You gotta take it with you. The Trooper should know better. Fortunately, nobody was klled o hurt.
