Thread: Erroneous info given to Sheriff's Dept while applying for permit

My 2 adult children and myself applied for local pistol permits. I recently received a letter from the Sheriff's office stating that during my routine background check, the Sheriff's Dept. received information about me that is erroneous, harmful, what I consider degrading and will probably cause the denial of a permit.

I clarified my name, DOB and SS# with their office, and wrote to the source who provided them with my SS# DOB, name and incorrect information. I asked to be provided with a copy of this information asked where they got my SS and other info. I have not heard back from anyone. It's been 2 weeks or longer.

What recourse do I have to prove that the info given to them is false or mistaken? There is no phone number for the source, only an address. Is it illegal for the source to provide false information and disregard my letter?

Has anyone else ever had a problem such as this where a background check brought up information that was not yours?

    Thanks
Anything that comes up in your backround could prevent you from getting approved.Since it was denied you have one year to clear up the mess and hire an attorney. Many people who apply must remember that a check is done with all local police departments in your county. If you had any problems in the past it comes up no matter how minor it is.

I'm considering a visit to their office. Aside from denial of a permit, my primary concern is having my name and personal information connected with false allegations.

My reason for posting was to know if anyone else had ever had anything like this happen to them.

Thank you for the replies and welcome.
How long did it take you to be notified that your permit was denied. The office that reported is not a gov't agency and the det. gave a name and address to write to?......I believe something is very wrong here with your investigation. This is coming from my LE experience, you had a backround check. What happened is a group search was done by your name and dob.You were on file, could be a prior domestic or a minor traffic offense. This how many people get denied in NY.It sounds like you had a problem with your backround. You must be of a good moral character to be considered for a pistol permit. If that is not met you get denied.

Hunter Won is right. There is no definition for "good moral character" and that is left up to the issuing judge. It sounds like they uncovered something in your background that was cause for denial. It could be a mistake, and mistakes have been made in the past. The Sheriff's office will not help because as far as they are concerned, the information is accurate and their investigation is complete. In NY, the Sheriff does the investigating and a judge has the final say if a permit is issued or denied. You will need all relevant information to this event in your background. I am not sure what type of agency reported, but you will want to follow up with this agency and you may need to hire a lawyer to clear it up.

  5. This sounds very odd to me.Someone had an issue with a certain judge and county. He stirred up a hornets nest at first saying it was idenity theft and that was the reason. He was denied due to his backround which he tried to cover by bashing the judge and local police in his county. You can get some very honest answers here. What county did you apply in?....your adult children also applied. If you have something to hide forget about wasting our time .

Y'know, I think all of us here have something to hide. 99% of us don't use our real names, and many of us don't like divulging any or all personal info. We are under no obligation to read anyone's posts. I, for one, am interested in what she has to say, especially in the resolution of her issue. Seems to me she is just testing the waters here, just as we query her to make sure she's not an anti coming in just to stir up trouble. That's my story and I'm sticking to it.

Thank you for this post and understanding. Some on here appear to be amateur sleuths or very suspicious individuals. Why? You're digging for something that you're not going to find.

My original post was a question: Has anyone's BG check come up with incorrect info and if so, what did you do about it. This thread has turned into a prelude for a mystery novel thanks to some wild imaginations on this board - which is part of the reason I do not feel comfortable posting personal info. Some people are very quick to judge if someone doesn't pour out their personal info on day one.

I googled and found a link and phone number. I know this sounds like I'm hiding something, but all I am withholding is a hurtful mistake - hopefully clerical - that someone made 26 years ago.

I have no past to speak of. Never been arrested - never been involved in any legal matters. This is why I was shocked to receive this letter. Had I been in trouble as a kid or something like that, I wouldn't be so upset. I'm calling tomorrow - and will probably have to make a trip up there on Thursday.

I will let you know what develops and hopefully have a resolution. When it's all cleared up I'll tell you what happened. Hopefully my news will disappoint Hunter Won, who seems to be looking for excitement and angry that I wasted the time he spends on a message board.

There have been some nice people on here to offer support and info, and I thank them. This is what I came here for - not to snoop - but for the answer to one question. Has anyone had this problem and if so, were they able to solve it.

This forum has more than its share of people that are big on opinion and short on useful information. I know nothing of New York laws but I'd start by asking your questions at NorthEastShooters:
    Northeastshooters.com
and New York State Rifle and Pistol Association:
New York State Rifle & Pistol Association
They will likely be much more useful to you in your search for choices.

More than it's share? I doubt that.

To the OP, you didn't ask 1 question; you asked three. So, some posters asked for clarification. Big deal.

Sheesh...guess we should all just keep our mouths shut when a new poster asks for help. That'll make 'em feel welcome.

Considering the signal-to-noise ratio on some of the threads here refraining from providing misinformation when one has no information would be a definite improvement.

You have to wait a year to re-apply.Remember once you get denied a pistol permit it becomes very difficult to get one.And yes thank you for thinking that, I tried to help someone here that was using the identity deal with his denial and it turned into a complete debacle. That person was a problem and used every excuse possible.Good luck with getting a pistol permit....I was only trying to help!!!
