    hello everyone -

    im just filling out my permit and its asks about previous arrests. i have no idea what the dates were of my previous arrests; it was at least 10 years ago when i was in my 20's or even longer than that back in my teens.

    what is the best way to go about getting this information ? ive tried a few online searches but they all want money - i thought it was all public record ?

    dont they have access to all of it ? i dont mind filling it out and all but why all the trouble if they can just type in my information and pull it up? perhaps it doesn't work like that though!

    No. You need to list each arrest with exact dates and disposition. Furthermore you need to obtain an official certificate of disposition from the court and submit that with your application. (it may not say this on the application BUT you will be called to obtain this once the application is processed so just send it in up front to save yourself a month or so).

    Now the bad news. NY is not forgiving for any convictions when obtaining a pistol permit. If you have any theft, violence, drug or DUIs (including the non criminal DWAI) out there, you may be turned down even if it was 10 years ago.

    wholy **** - wow - when i went to get the permit the lady ( the county clerk ) who gave it to me and explained everything said nothing about that ?? - ive been in this county for about 3 years now. was last arrested when i was younger than 21 years of age (so more than 10 years ago)- in a different county than i currently reside in. it was for breaking into cars as a kid and stealing things. stayed overnight, did my 3 years of probation & restitution, released early, years ago (may have the release from the prob officer still?) and here i am now - been pretty much a saint ever since - learned my lesson well.

    so i have to make it to the country where the incidents occurred and obtain a certificate or paper ? where do i do this? is there a fee? do i go to the county courthouse? or is this something i can call for and obtain over the phone?

    and you're saying that most likely, even it was something that was 'expunged' or 'sealed' due to my age that there is still a very small likelihood that i will be able to obtain my permit?

    im a bit blown away - and bummed - im trying to get my permit because my father has some pistols he wants to make sure go to me when he passes - only child and hes not married or anything - and wants to be sure the state dos not end up with them - i guess i will have to have my wife apply for her permit as

    Ok. Take a deep breath. I re-read my reply to you and I think I came off a bit harsh, which was unintentional.

    You can order your certificate of disposition over the phone from the court. You shouldn't have to go there. Also, any favorable info from your former PO would be helpful.

    Secondly, apply and explain what happened then and why you want a permit now. Don't let what I stated discourage you. It's ultimately up to the judge that gets your packet. Saying you were young and stupid goes a long way 10+ years later.

    Don't panic--it's not over yet.

    Also, I hope your dad has a will so his estate won't need to be handled by the state. If in doubt, check with a NY lawyer, not the internet.

  7. I have some experience here in that I used to live in N.Y. The whole thing comes down to the judge that will make the decision. You can go from a judge that require's you to come in for the interview and answer questions as to why you need this permit( in my view is un-constitutional) to a judge that will just mail the permit back stamped full carry, which I know has happened. The whole process is so unlawful it's just silly. Come to Missouri where you don't need a permit if you just want a gun for protection in your home or to carry open. If you want conceal you need permit which you take a 8 hr. class and a backround ck.,$100. and your in.Takes about two weeks I think. To buy a gun here it's easy as going in to your store of choice and pick out a gun fill out the paper work for backround ck. and you walk out. Total time about 30 min., if you pass the bkrd. ck. So I'm sorry you live in a socialist state.As of January we will be a constituional carry state. So come on down, lower cost of living here.
