    Daley's Attorneys Are Out of Their League

    King Richard the Fascist is fighting the rong battle. Given McDonald, the battle now is not about guns, but involves a legal concept called Strict Scrunity. According to Wilpedia -

    To pass strict scrutiny, the law or policy must satisfy three prongs:

    First, it must be justified by a compelling governmental interest. While the Courts have never brightly defined how to determine if an interest is compelling, the concept generally refers to something necessary or crucial, as opposed to something merely preferred. Examples include national security, preserving the lives of multiple individuals, and not violating explicit constitutional protections.

    Second, the law or policy must be narrowly tailored to achieve that goal or interest. If the government action encompasses too much (overbroad) or fails to address essential aspects of the compelling interest (under-inclusive), then the rule is not considered narrowly tailored.

    Finally, the law or policy must be the least restrictive means for achieving that interest. More accurately, there cannot be a less restrictive way to effectively achieve the compelling government interest, but the test will not fail just because there is another method that is equally the least restrictive. Some legal scholars consider this 'least restrictive means' requirement part of being narrowly tailored, though the Court generally evaluates it as a separate prong.
    This in not a gun fight, but involves Stare decisis, based on cases involved in other Fundimental Rights cases involving the 1st, 4th, and 5th Amendments.
    The Ninth Circuit Court of Appeals has stated:
    Stare decisis is the policy of the court to stand by precedent; the term is but an abbreviation of stare decisis et quieta non movere — "to stand by and adhere to decisions and not disturb what is settled." Consider the word "decisis." The word means, literally and legally, the decision. Nor is the doctrine stare dictis; it is not "to stand by or keep to what was said." Nor is the doctrine stare rationibus decidendi — "to keep to the rationes decidendi of past cases." Rather, under the doctrine of stare decisis a case is important only for what it decides — for the "what," not for the "why," and not for the "how." Insofar as precedent is concerned, stare decisis is important only for the decision, for the detailed legal consequence following a detailed set of facts.
    What His Dishonor is trying to do will be run through that mill, and what the ACLU (and other liberal groups) were able to establish regarding Strict Scruntiny will apply.

    Dictator Daley is a very dangerous, unrealistic nut job. If he remains in power he will continue to think of himself as a supreme being. When in hell is his term up? If the people of Chicago re-elect him again, then I would say it's only a question of time until the city of Chicago will find itself the subject of so many lawsuits that it will go broke trying to defend them all. Probably then dictator Daley will decide to print his own money. With his picture on it. Just like Saddam.

    Daley is just following the lead of the piece of garbage in the whitehouse. They both know everything, they both know what is right, and if it conflicts with the law, the constitution, the supreme court, the LEGAL citizens of this country, or anything else, it does not matter---THEY ARE RIGHT ALL THE TIME!!! Their end always justifies the means.

    he can't actually believe that less guns in the hands of the law abiding will actually make crime go down can he? I mean I'm sure he's criminal enough..... oh... I mean smart enough to realize that criminals are criminals because they don't care what the law says and go do what they want anyway...
