Thread: pardon and delays

  1. pardon and delays

I was convicted of a felony in 1993. Did my time haven't been in trouble since then. Earlier this year I filed for a full pardon for that crime in the state that I was convicted in. I had to attend a few meetings in front of the Governor, Sec of State and Attorney general of that state. a month and a half ago the pardon was granted and more specifically restored my 2nd amendment rights. After I received my certificate of Pardon I purchased my first hand gun thru a private sale. I also called the FBI and asked how long it would take for their records to be update, the answer I got was check with your state if it is updated there then it will be up to date in the national system. so I went to the webpage for that state and looked up my information (for a fee), it was updated with the "Pardon Granted" as the first note on the case. I thought at that point I would be okay.
I went down this week to the local Sportsman's warehouse and tried to purchase a nice sporting rifle and was delayed (I guess it's better then a flat out denial). My question is, Does anyone know will the feds spend more time than the 3 days to research a record. Sportsman's will not sale a firearm without a Proceed from the system. Sportsman's did tell me they hold the firearm for 30 days in the back room and if they get the proceed they will call. my understanding was that the FBI will take 3 days after that it will be less of a priority and may not finish the investigation. Does anyone have a clearer idea of how this works? I will file for a UPIN but have read that I need to wait 30 day to start that process.

To be quite honest, you never know how long a Delay will take to get cleared. Yes we have seen them take over 30 days to clear. A lot depends on how busy they are and if they even have anyone working appeals/delayeds.

  4. Its been almost 2 weeks still on delay. I have called the FBI NICS but all I get is a message that they are too busy to take calls today. Frustrating. But a delay is still not a denial, at least that's what I tell myself to feel a bit better about it lol.

  5. So I never got cleared to purchase the sporting rifle I attempted to get a couple months ago. I sent in all my paperwork to the feds several weeks ago to try and get a UPIN, not expecting to hear anything back for a while. I went to Cabelas last week put my hands on a browning X-bolt, fell in love and made the attempt once again to make a purchase. Wouldn't you know it, I was delayed again (fully expected it this time). I was out of town for the rest of the week and wasn't able to get calls most of the time so when I returned home I called Cabelas to see if there was a change in the status of the delay. the gentleman on the phone said it move to proceed and was able to be picked up at anytime. the next day I made the drive to town to pick up my new hunting rifle. I asked the guy that was checking me out if I actually got a Proceed or if it was the Brady law kicking in because of no response from the feds. After looking at the screen for a min or two he stated that it was moved to proceed from the feds the next business day after the attempted purchase (it was New Years weekend when I made the initial attempt). to add icing to the cake Cabelas sold me the rifle for the same price it was listed the day I first tried to buy it even thou the sale was over, Saved me $100.

The X-Bolt's a great rifle. Very comfortable to hunt with.

Not sure why you're so determined to buy through an FFL retailer when you've already bought a handgun in a private transaction. You know you're legal to buy, so why not just find the rifle you want on Armslist.com or some other way of locating private sellers in your state, buy it, and get on with life? You can get what you want and then work on getting the paperwork straightened out, but there's no reason to deprive yourself of possessing arms just because the government is as screwed up as it is. It's going to remain screwed up for the rest of your life, whether or not it eventually gives you permission to own all the rights your pardon entitles you to. You'll even save a little money buying used. Maybe make a new friend to shoot with in the seller. You know what you want. Go find it and buy it and quit allowing government to control your right to do it. That's my best advice.

  8. Had a mess up trying to RENEW my concealed carry license. They spotted an arrest from 1991 and because it was so long ago they "supposedly" couldnt access the court records to see the final outcome. Took over 6 months to get straightened out. Finally got a denial reversal letter and number. Now when I purchase I have to keep giving them this damn paperwork and going through this extra crap on the background check. My only advise it to keep fighting the denial letters you get until it is straightened out

Again, why? Why not just buy private party and eliminate the liberty-killing middle-government out of the process? He knows he's legal to buy. Why waste time jumping through Uncle Sam's hoops? It doesn't make a lick of sense to me that you would give that advice, or that someone who knows they're legal buyers would follow it.

And in most States, no record of him having it.

Well, of course that is *my* #1 reason for buying private party, but just pragmatically, I am baffled why anyone would either recommend delaying the process of legally acquiring weapons, or follow such a slave-to-government-control recommendation. And of course if you ask people why they would make such a recommendation, they never answer.
