    Just released by Tresmond Law (esp. note the last sentence):

    For Immediate Release


    (Buffalo, New York) For the record, it is our position that the New York State Police targeted our client, Mr. Lewis, from the outset of their request that his pistol license be suspended. New York State Police officials provided Erie County Clerk Chris Jacobs with our client's name, address, pistol license number, number of handguns owned by Mr. Lewis, and other identifying information that made it clear they were looking for our client. Our client was contacted by the New York State Police. This is not a simple case of mistaken identity. Mr. Lewis's medical privacy was invaded and he was publicly defamed and humiliated by New York State officials. We will file suit shortly.


    As many are well aware, our client Mr. Lewis had his pistol license suspended by a New York State Supreme Court Justice at the request of a New York State Police Sergeant. The NYSP official requested the suspension pursuant to the mental health provision of the NY SAFE Act of 2013. Upon our investigation, we determined that Mr. Lewis’s medical records had been examined without a valid search warrant, in clear violation of federal and state privacy laws in addition to the New York State Criminal Procedure Law. On Thursday, April 11th, 2013, New York State Supreme Court Justice M. William Boller reinstated Mr. Lewis’s firearms license. New York State police officials claim they “had the wrong guy”. The evidence tells another story. Mr. Lewis was directly targeted by Sgt. Jackson of the New York State Police and further investigation reveals systemic fourth amendment violations within the New York State government.


    Confidential informants from within the New York State government have since come forth with information regarding the creation a clandestine “HIPAA” unit comprised of approximately seven members within the Division for Criminal Justice Services , charged with examining New York residents’ medical records without warrant


    We will be relentless in our pursuit of the truth and justice in this case.

  4. Dare I say it given it is so obvious? This reads like a test case in a pilot program for the Federal Government to enact. What worked, what didn't, what were the obstacles, who were the opposition...
    When all other methods of protest have been dismantled, the system leaves us with only two options: stand and fight, or kneel and beg for mercy. All you need to know is what YOU would do when faced with that choice.

    I would love to see them sued for hundreds of million dollars, them forced to reinstate his license and return anything taken.

  6. Reputation, feelings of low self-esteem, a sense of betral by law enforcement and the medical community . . . and much more are not easily reinstated, corrected or returned. Then again, several hundereds of millions of dollars just may be a good start.

    "Less communist". Says a mouthful about our nation, doesn't it? The best we can shoot for nowadays is to live in the least communist state available.

    This is all a 'great shame'.
    I lived in NYC, hunter in NYS for years. I held a NYC pistol permit for over 20 years.
    Yes the law was strict, but you knew, after passing NYC Firearms Checks, you could pass anything.
    NYS Conservation was outstanding and would rank with any State in our Union. I was a NYS Conservation Safety Instructor
    and I can tell you, first hand, when a person passed the course he/she knew what they were doing.

    A few people have destroyed this with the movement of a pen.
    Cuomo's actions in less then a year, has destroyed work that had taken 40 years.
    Actions that are tunnel vision and only can see a white house though his eyes.
    A true opportunist, who will not miss a chance, to be in the spot light, even if its though tears of sorrow.

    I SAY THIS--- If your politician is passing laws, that punish you, for the actions of the very few---- VOTE THEM OUT OF OFFICE.
    They are in office for themselves not for the good of America.
    Their actions, words, deeds, tell me-- If its good for them, then its good for America. If its not good for them, then $^& America.

    Some time during the last week of April, the State of New York has to answer an prove to a judge that the NYSAFE Act is Constitutional.
    The possibility of an injunction is at least 50/50.
    Once the time and date is known. I will be driving there to watch the proceedings.

    Indeed, the buzzards New Yorkers kept electing and reelecting into office have come home to Albany to roost. The failure of New Yorkers to realize that laws "their" buzzards were passing that made it illegal/nearly impossible for a NON-resident to bring a gun and ammo into the state COULD be so easily and quickly turned against residents is exposed for the rest of the world to learn from. New Yorkers fight on - hopefully to WIN - while the "SAFE ACT" is stamped "FOR EXPORT TO THE OTHER 49 STATES" by the anti gunners. Eternal vigilance is the price of liberty. Don't wait for the evil twin of the "SAFE ACT" to even be introduced in YOUR OWN state.
