    After James Madison's Bill of Rights was submitted to Congress, Tench Coxe (see also: Tench Coxe and the Right to Keep and Bear Arms, 1787-1823) published his "Remarks on the First Part of the Amendments to the Federal Constitution," in the Federal Gazette, June 18, 1789 He asserts that it's the people (as individuals) with arms, who serve as the ultimate check on government:
    As civil rulers, not having their duty to the people duly before them, may attempt to tyrannize, and as the military forces which must be occasionally raised to defend our country, might pervert their power to the injury of their fellow-citizens, the people are confirmed by the next article in their right to keep and bear their private arms.

    Earlier, in The Pennsylvania Gazette, Feb. 20, 1788, while the states were considering ratification of the Constitution, Tench Coxe wrote:
    Who are the militia? are they not ourselves. Is it feared, then, that we shall turn our arms each man against his own bosom. Congress have no power to disarm the militia. Their swords, and every other terrible implement of the soldier, are the birth-right of an American...The unlimited power of the sword is not in the hands of either the federal or state governments but, where I trust in God it will ever remain, in the hands of the people.

    (Reuters) - Eight members of an extremist militia group accused of conspiring to kill law enforcement officers as part of a wider war on the U.S. government pleaded not guilty in federal court on Wednesday.

    Attorneys for the eight sought to fight government efforts to have the defendants detained for the duration of the proceedings, a court case that one of the lawyers predicted would be "a mega-trial that will take years to unfold."

    The group's leader, 45-year-old David Brian Stone, had planned to take over three or four rural counties in southeastern Michigan and use the toehold to ambush and kill members of U.S. law enforcement, Assistant U.S. Attorney Ronald Waterstreet said.

    The Christian militia group, which called itself the Hutaree, viewed the police as their enemy because they believed U.S. law enforcement officers were acting as agents of a "new world order," Waterstreet said.

    Prosecutors played a recording which they said was taped by a federal agent who had infiltrated the group.

    In it, Stone read from a speech he had prepared to deliver at a February meeting of other militia groups in Kentucky -- a meeting that was ultimately canceled because of a snow storm.

    "How much longer are you going to put up with a foreign army controlling your streets and highways?" Stone was heard saying.

    "Now's the time to strike and take our nation back."

    William Swor, the attorney defending Stone, said his client was only exercising his constitutional right to free speech.

    "What we heard today is that Mr. Stone talks a lot, that Mr. Stone is angry," Swor said in court. "There's nothing that says he was looking to make war on the United States."

    A lawyer for the ninth suspect arrested in the four-state raid, Thomas Piatek, 46, of Whiting, Indiana, agreed with that assessment.

    "The question is where they actually serious, or just a bunch of guys beating their chests and issuing rants?" said Jerry Flynn, his court-appointed attorney.

    "There are a lot of allegations with very little proof."

    An FBI agent said Piatek had nearly 50 firearms and thousands of rounds of ammunition in his home. A magistrate judge in Indiana ordered Piatek transferred to Michigan, where he could stand trial with the others.

    A federal grand jury indictment unsealed this week in Detroit charged the eight men and one woman with seditious conspiracy, attempted use of weapons of mass destruction, and possessing a firearm during a crime of violence. They could face up to life in prison.

    There's nutjobs on both ends of the spectrum. On one side, they arm themselves to the teeth, hoard food and ammunition, and develop plans to take on local law enforcement and the national guard in preparation for the coming apocalypse. On the other side, they all get purple Nikes, matching sweatsuits, shave their heads, then drink poisoned Kool-Aid and wait for the UFO hiding in the tail of the Hale-Bopp comet to come pick them up.

    Me, I'll reserve judgment before I come down on one side or the other of this situation. You gotta realize where you are getting your news, because no matter what you read, see or hear, there is nothing completely unbiased and neutral.

    DETROIT (Reuters) - The extremist militia group members accused of plotting to kill police and wage war on the U.S. government should be freed pending trial because the case against them centres on political, not criminal issues, defence lawyers argued on Thursday.

    Lawyers defending eight of the people charged in the case asked a judge during a hearing in Detroit to grant bail to the militia members, arguing that merely possessing weapons and voicing opposition to the government is not illegal.

    Assistant U.S. Attorney Joseph Falvey told U.S. Magistrate Judge Donald Scheer the defendants, members of a group called the Hutaree, had "dark hearts and evil intent." Falvey said they broke the law by conspiring to oppose the U.S. government by using violence and weapons, and should be denied bail.

    The seven men and one woman on Wednesday pleaded not guilty or remained silent and had not guilty pleas entered for them.

    An indictment unsealed on Monday accused them of planning to kill a police officer in Michigan and then ambush the funeral with improvised explosive devices to kill more police. The defendants were preparing to fight authorities from fortified and booby-trapped positions, the indictment said.

    Members of the Hutaree believed the attacks would "serve as a catalyst for a more widespread uprising" against the U.S. government, the indictment said.

    Michael Rataj, the lawyer representing the wife of the group's leader, said the government was "prosecuting people who have only exercised their First and Second Amendments rights" under the U.S. Constitution to engage in free speech and own guns, and had not violated the law.

    Other defence lawyers made similar points. Prosecutors and defence lawyers argued over the threat the suspects might pose if released on bond and the likelihood that they would show up for trial. The judge said he would rule by the end of the day on Friday on whether or not to release them on bond.

    GUNS AND AMMUNITION

    Authorities said they recovered dozens of handguns and rifles, tens of thousands of rounds of ammunition, and explosives and bomb components in raids on the suspects' homes last weekend.

    The federal grand jury indictment charged the defendants with seditious conspiracy, attempted use of weapons of mass destruction, and possessing a firearm during a crime of violence.

    If found guilty, they face a minimum of between 30 years and life in prison under U.S. sentencing guidelines, prosecutors said.

  9. I'm 100% pro 2A. But when you're talking about shooting cops and blowing up funerals thats a little overboard. Not the label law-abiding gun owners need to be branded with.

    (Assuming the reported charges are real and not manufactered by the gov't like Ruby Ridge was)

    Ok, lets say for a minute that the government allegations against the Hutaree are true. That means that 9 whole wingnuts are running around planning to overthrow the entire government. All by themselves.
    Now, look at what our Federal government brought to the party. I saw a armored personnel carrier, bulletproof vests, automatic weapons, helicopters and many many federal police.

    Just whom should I be more afraid of? Loons in the woods or heavily armed and armored troops storming citizens houses?

    Same scenario in Waco, heavily armed federal police, helicopters, tanks, automatic weapons and on and on and on.

    Meanwhile, illegal aliens pour across the border, drugs flow freely and gangs rule the inner cities. I'm sure glad the government is protecting me from those dangerous Hutaree folks. I feel much safer now.
