    I think Kagan will make a good justice. I don’t think she would have voted with the majority in Heller or McDonald, but I think like most liberal leaning justices she has a high regard for stare decisis.

    Liberal justices ten to be intellectually driven, while conservative justices tend to be reactionary. For example, compare the opinions of Sotomyor and Ginsburg with those of the Scolito brothers. Sotomayor and Ginsburg support their opinions and dissents with intellectual rationale, while the Scolito brothers usually just mock the opposition rather than justify their own positions.

    Roberts and Thomas are exceptions to the rule, although Thomas simply doesn’t have the intellectual ability to compete with the others, at least he tries, unlike the Scolito brothers who seem content to premise their judicial reasoning solely on their perceived weaknesses of the other side’s rationale.

    Name calling isn't a sign of genius. That is what people do when they can not present a reasoned argument.
    I do not agree with RBG for example, but I would never question her intelligence. Her motives, loyalties and honesty yes, but not her intelligence.

  10. Don't get fooled.

    Kagan is just smarter than Finestein. To answer her in any other way was an automatic rejection and she knew it. Kagan would tell you that the Earth's flat and the moon's made out of green cheese to get confirmed for the seat on the USSC. She's still an administrator and ideologue with a law degree that has never been on a bench, so there is no history of her rulings to prove what her stances are on issues.

    Please note that when someone does come up with something written by Kagan, she says, "That's not my opinion, that's a position paper for the Administration." or "That was Harvard policy. As Dean, I had to follow policy." Personally, all the vagueness and slipping and dodging issues and questions is even more worrisome than the far Left wacko's or the world like Finestein.

    I don't know what exactly she believes but I'm pretty sure I ain't gonna like it.
