    House Committee Passes Amendment to Defund Illegal Obama Firearm Sales Reporting Requirement

    Today, during consideration of the FY 2012 Commerce, Justice, Science Appropriations bill, pro-gun U.S. Rep. Denny Rehberg (R-Mont.) offered an amendment to prohibit the use of funds for a new and unauthorized multiple sales reporting plan proposed by the Bureau of Alcohol, Tobacco, Firearms and Explosives. The Amendment was passed by a vote of 25-16.

    The Rehberg Amendment, which was strongly supported by NRA, will defund the Justice Department’s controversial and illegal move requiring federally licensed firearms retailers in states bordering Mexico to report multiple sales of semi-automatic rifles.
    As we reported yesterday, this procedure was proposed last fall as an “emergency" measure by BATFE. Specifically, it calls for all of the firearm retailers in California, Arizona, New Mexico and Texas to report multiple sales, or other dispositions, of two or more .22 caliber or larger semi-automatic rifles capable of accepting a detachable magazine purchased by a single individual in a five consecutive business day period. It is important to note that under existing law, BATFE already has full access to every dealer’s firearm transaction records, either during a bona fide criminal investigation or simply to enforce compliance with record keeping requirements. This new reporting procedure would create a registry of owners of many of today's most popular rifles--firearms owned by millions of Americans for self-defense, hunting and other lawful purposes. Most importantly, however, the BATFE has no legal authority to demand these reports.
    In addition, the agency has recently come under intense scrutiny due to its ill-conceived “Fast and Furious” operation. "Fast and Furious" encouraged Arizona gun stores to sell thousands of guns to suspicious buyers, despite objections from dealers and even BATFE’s own field agents.

    Earlier this year, the U.S. House of Representatives voted on and passed, by a vote of 277 to 149, an amendment to H.R. 1 (also offered by Rep. Rehberg, along with Rep. Dan Boren (D-Okla.)) that also would have prohibited the use of federal funds for this reporting requirement. Unfortunately, the amendment was not included in the final version of the bill as a result of Senate inaction.

    In March, U.S. Sens. Jon Tester (D-Mont.) and Richard Burr (R-N.C.) introduced S. 570--“to prohibit the Department of Justice from tracking and cataloguing the purchases of multiple rifles and shotguns." The bill would ensure that federal funds cannot be used for the multiple sales reporting procedure.

    NRA will continue to work to make sure the Rehberg Amendment makes it through the appropriations process. The amendment is scheduled to be heard on the House floor in August.

  4. Administration officials told Newsweek and The Daily Beast that starting as early as next week, Obama will begin a series of changes designed to tighten regulations and penalties under current lawsóbypassing a fight in Congress with the pro-gun National Rifle Association in the process.
    This speaks volumes...bypass congress...who would have thought...and there are people that cheer this on?

    Forget gun control. Try criminal control instead. In NYS the average sentence for child rape is 2.5 years. The average sentence for homicide is about 10 years.

    Ilegal possession of a handgun can carry 3 years. Perps see this as a badge of courage. What would happen if criminal use or possession of a firearm carried a minimum of 15 years w/o possibility of parole?

    Outside of NY I would agree with you, but it's too easy to run afoul of NY gun control laws. If we made the laws more understandable and less rigorous, I would agree with you.

    Jim, I'm only referring to those who commit criminal use of a firearm, not legal citizens who are caught carrying outside of restrictions. They haven't committed a crime, just an administrative violation. When I find an unlicensed person with a violent or criminal history, I want him gone for a long time.

    Whenever a new law is proposed, such as this Border State Reporting Law, I always try to apply a common sense filter: Does it truly thwart criminal activity? Can it be circumvented by criminals? Can the law be expanded to other areas or more items be added to give the law more teeth? How dangerous can this law possibly become to freedom?

    This one rates a solid 7 out of 10 on the common sense filter.

    Outside of NY I would agree with you, but it's too easy to run afoul of NY gun control laws. If we made the laws more understandable and less rigorous, I would agree with you.
    This points to a whole different set of issues.... the niche market that law-makers and attorneys create for themselves. Can anyone point to one good reason why reading and understanding the laws of a US, any state, county or city should require a team of lawyers and judges ?

    I mean a reason OTHER THAN job security for the legal profession !!

    It should be plain and simple... any person of reasonable intelligence should be able to read a section of laws and understand EXACTLY what is required and expected. We keep hearing that ignorance of the law is no excuse.... I contend that in MANY cases it's not as much ignorance of the law as it is the ridiculous feat of understanding the content.

    I am NOT giving rapist, muderers or bank robbers a free pass here.. those acts are clearly illegal.. but reading and understanding MOST state and federal carry/non-carry laws is a major under-taking and often open to individual interpretation (YMMV).

    Sorry... pet peeve with ALL legal code - don't get me started on single purpose legislative bills..... :p

    What line? This administration has never seemed to be limited by any "line" or other restrictions. The Pied Piper does as he sees fit and to hell with Congress. His list of czars enable him to do any thing he wants with impunity. He has had a free ride for the last couple of years and answers to no one. Where have our lackluster politicians been while he has done this? If he wins re-election next year, you will see SHTF big time and there will be no stopping him or his minions. After we have totally gone over to Socialism, next you will see a Muslim flag over the White House. Then all the Liberals will see how they have been deceived. This nation has turned from Godly to Godless and we are about to reap what we have sown. We had all better get out and vote next November!
