    People that retarded should not be put into a position of authority. And if they accidentally are and are found to be that retarded, they should simply be shot. I am so sick of reading things like this. I visit several forums, including one that posts screwed up news from around the world, and this kind of stupidity seems to be a weekly occurrence.

    That's the result of excess enforcement, excess power delegated to incompetents, excess regulation from a bureaucracy, excess political grandstanding creating such a bureaucracy, excess prosperity leaving people with not enough to worry about to stop such inanity. Makes me wonder what real crime was being committed while real crime was being ignored by the administrative judge issuing the warrant, the agent diverted from real animal endangerment, the trooper diverted from enforcing criminal law or safety laws on the highways, etc etc etc.

    I've written to the Federal Department of Fish and Wildlife, along with the Virginia Department of Game and Inland Fisheries. (Not sure who the culprit is, from the article, but this really smells like a Federal operation to me.) I suggest all of you do the same.

    Now, when this woman is convicted of whatever stupid crime she will be accused of, she can run for Congress.

    So they should have just allowed the cat to kill the bird - right. Ranks right up there with the zero tolerance stuff in the schools.

    All you would need is me as a judge. If this stupid crap made it to my courtroom, I would have the prosecutor jailed six months for criminal stupidity and crimes against justice.

    As a result of my inquiry - I received the following reply from Virginia Department of Game and Inland Fisheries:


    Thank you for contacting the Virginia Department of Game and Inland Fisheries (VDGIF). The Virginia Department of Game and Inland Fisheries did not participate in this inquiry. The U.S. Fish and Wildlife Service (USFWS) is responsible for the protection of all federally listed migratory birds, and is the agency that initiated the inquiry referenced in your email. The USFWS has issued the following statement regarding the case. Comments, questions, or concerns should be addressed to USFWS.

    Virginia woman unintentionally issued citation
    On June 13, a special agent with the U.S. Fish and Wildlife Service observed a woman carrying a cage that contained a woodpecker at a home improvement store in Fredericksburg Virginia. As possession of a bird may potentially violate the federal Migratory Bird Treaty Act, the agent initiated an inquiry to determine whether a potential violation had occurred. Upon speaking with the subject, later identified as Alison Capo, on June 27, the agent determined that no further action was warranted. A citation that had been previously drafted by the agent was cancelled on June 28.

    Unfortunately, the citation was processed unintentionally despite our office’s request to cancel the ticket. The Service has contacted Ms. Capo to express our regret. The Service is also sending Ms. Capo a formal letter explain the clerical error and confirming that ticket should never have been issued. This misunderstanding was the result of a Service inquiry into possible violations of federal wildlife law. In particular the Service is responsible for the protection of all federally listed migratory birds. The Virginia Department of Game and Inland Fisheries did not participate in the inquiry.
