    Now I'm more confused than I was. What is it that actually happened? It looks like we can already be arrested for being beligerant and that has not changed.

    They make this crap so confusing that we finaly throw our hands up and say to hell with it.

    We need a real lawyer here or someone that can define this whole section cause it seems to contradict itself in several places.

    What trumps what?

    I have a flash for all you "Super Patriots". The new appropriations bill is simply following the guidelines of every other Armed forces appropriation bill since Abraham Lincoln's administration.

    The wording below is from the 2008 Appropriation Bill but it is characteristic of all of them. Once the bill becomes Public Law the full authority to carry out military actions within the U.S. with Regular troops is in effect. The newer Senate bill simply reflects the specifics of the Bush Patriot Acts. This ruse has been used to over ride the “Posse Commitatus” provisions and justify Executive military action many times since “Uncle Abe” used it to establish a dictatorship in 1863. Obama didn’t invent it and it isn’t anything new. We have been living under “the gun” most of this nation’s history. Justification for the legality of this action falls under the “General Welfare” clause in Section I of the Constitution, so yeah, it is Constitutional. The question was asked as to when the Constitution was scrapped and we started down hill. The answer is it started under John Adams , with the Alien and Sedition Acts and really hit high speed under “Father Abraham” in 1861-1865. We have only had one “Constitution believing” President since that time. Grover Cleveland.

    § 333. Major public emergencies; Interference with State and Federal law
    (a) USE OF ARMED FORCES IN MAJOR PUBLIC EMERGENCIES.--
    (1) The President , by using the militia or may employ the armed forces , or both, or by any other means, shall take such measures as he considers necessary to, including the National Guard in Federal service, to--
    (A) restore public order and enforce the laws of the United States when, as a result of a natural disaster, epidemic, or other serious public health emergency, terrorist attack or incident, or other condition in any State or possession of the United States, the President determines that--
    (i) domestic violence has occurred to such an extent that the constituted authorities of the State or possession are incapable of maintaining public order; and
    (ii) such violence results in a condition described in paragraph (2); or
    (B) suppress, in a State, any insurrection, domestic violence, unlawful combination, or conspiracy if it-- such insurrection, violation, combination, or conspiracy results in a condition described in paragraph (2).
    (2) A condition described in this paragraph is a condition that--
    (1) (A) so hinders the execution of the laws of a State or possession, as applicable, and of the United States within that State or possession, that any part or class of its people is deprived of a right, privilege, immunity, or protection named in the Constitution and secured by law, and the constituted authorities of that State or possession are unable, fail, or refuse to protect that right, privilege, or immunity, or to give that protection; or
    (2)(B) opposes or obstructs the execution of the laws of the United States or impedes the course of justice under those laws. (This section gives the Executive Carte Blanche authority to send troops. Comments are mine)

    Note that the wording is such that A U.S. citizen does not HAVE to be detained. I am not a lawyer, but to me that means the military has the option of transferring to a regular court OR NOT. I see no provision requiring the transfer to a civil court or denying jurisdiction of the military courts.

    That is so nice to say that the "requirement to detain" isn't in there. In Gov't speak that means we may but don't have to, it's Our choice. And I never thought I'd agree with Sen. Dianne Feinstein (D-Calif.), but even she reads it that way. And that is scarey!

    Remember though, service members are not a bunch of drones without judgement and discernment. Yes there are some duds that get promoted but anyone of any rank can blow a whistle without reprisal. For those of you who fear martial law, don't put yourself in a situation where you fall on the wrong side of the law. That way you no longer have anything to fear.

    (2)(B) is the key there. I bet many here have never lived in a part of the US that had armed US troops patrolling under Martial Law. Articles about Dade County by Date - Page 2 - Baltimore Sun Many people went to jail just for being out after dark or before sunrise and taken there by National Guard, Army, or state law enforcement. The good thing was the Army troops couldn't have live ammo unless the FLNG troops gave it to them. So every group had a FLNG guy with them. Same thing happened in New Orleans after Katrina with the LANG.

    See my post above. If it wasn't for the fact that the Governor of Florida had issued letters to Gov't Agencies and Agencies of the State of Florida I could have been jailed for going to work. But my personal vehicle was issued a Emergency Vehicle plate and a copy of the letter was taped to the driver's side dash of my van. And I did get stopped and questioned. After it was removed so the Army Sgt could read it, I was able to continue on my way. A few years later, we were again issued those documents for another Hurricane.
