Thread: National Defense Authorization Act (2012)

As my good friend Billy Shakespeare would say, this is ”Much Ado About Nothing”. The fact is,the full authority to arrest and fully detain Americans ,using Federal troops,is already part and parcel of Constitutional Law and has been specified so by the USSC on numerous occasions. The source of all this authority starts with 10 USC 333, which is simply incorporation of the “Insurrection Act of 1807” into public law. John Adams used it, James Madison used it, Abe Lincoln lived by it, Teddy Roosevelt used it , FDR lived by it and GWB used it recently (Guantanamo, you didn’t really think there weren’t any American citizens imprisoned there did you?) This act also over-rides the Posse Commitatus Acts (Which btw pertain to states using federal troops for arrest, search and seizure, not the federal government!)

It has been incorporated into the Defense Appropriation legislation for several decades now. It is mainly a CYA to allow funding for these operations, setting authority under paragraph 2b of the 10 USC 333, in that troops can be used if there is a violation of an Act of Congress. This avoids much of the later litigation and court hassle for using paratroopers to grab American citizens off the street. The clause in the Appropriatio Act doesn’t set the authority it just removes the ambiguity in 10 USC 333. As far holding people until the “War on Terror” is over, that has to be done by repealing everything GWB and the Congress put into law covering said “war”.

Taking the offending clause out of the bill doesn’t remove the “GESTAPO” authority, it just greases the skids for the courts later. You can still be beat down by a burly Army Ranger and dragged off to solitary confinement for almost no reason at all. Americans need to wake up and realize that they lost their “free country” a long time ago. Abraham Lincoln just made it iron clad fact. It has rarely been done, probably because of fear of a popular uprising, either at the ballot box or in the streets.

In addition, and agreement with wjy2657, the damage was done long ago, but you can make a difference. Read the text of the amendments of which there are many. Look at what passed, and what was rejected. This is evidence that Congress and the Senate DO NOT want to reduce our indebtedness, DO NOT want transparency in government, DO NOT want to stop graft and corruption in defense contracts.
"The 2nd amendment was never intended to allow private citizens to 'keep and bear arms'. If it had, there would have been wording such as 'the right of the People to keep and bear arms shall not be infringed'." -- Ken Konecki on Usenet, on 27 Jul 1992
