Mark kelly’s video failed to show he was denied handgun purchase, too

    by AWR HAWKINS

Breitbart News can now report that although Gabby Giffords’ husband Mark Kelly successfully purchased a .45 caliber semi-automatic handgun from Diamondback Police Supply on March 5, the gun store had denied his attempts to buy a handgun approximately two weeks before that.
According to sources, when Kelly first came into Diamondback Police Supply in February he tried to use a Texas ID to buy a handgun and was denied. Then, thirteen days later–on March 5– Kelly walked back into the gun store with an Arizona ID that he used to purchase a handgun. He posted a video of that purchase made with a hidden “pocket camera” recording the transaction to prove that “background checks are easy.”
With the proper Arizona ID, Kelly successfully purchased a Sig Sauer 1911-style .45 caliber pistol. He also tried to buy an AR-15 rifle, but gun store owner Douglas MacKinlay ultimately halted Kelly’s AR-15 purchase due to concerns over whether Kelly could pass question 11a on background check form 4473, since Kelly had publicly claimed he had bought the gun to deliver it to someone else (in this case, the local police department).
On March 31 Breitbart News reported that when Kelly released his hidden video to show that “background checks are easy,” the failed purchase of the AR-15 appeared to have been edited out. Kelly’s apparent failed attempt to buy a handgun at the Arizona gun store in February didn’t make the final cut, either.

In other words, the current structure of our background check system stopped Kelly from buying a handgun once and an AR-15 after that. Kelly’s video hides both of those facts in order to create public pressure for expanded federal background checks.

Interesting article, but might I suggest that you learn how to link directly to the page where it appears, as opposed to the front page of the website? In a day or three, that article won't be on the front page anymore, and most people won't go hunting for it when it's gone from there. Your threads will get more activity if the link goes directly to the story. Just a suggestion.

So it appears the current system worked like it's suppose to. Is Kelley a resident of Arizona or is he a resident of Texas. If he's a resident of Texas why does he have an Arizona ID. Is he braking any law by showing two different ID"s to buy guns. Doesn't really matter, he's a liberal with good intentions and good intentions win out.

You can legally be a resident of more than one state. You can also get more than one state's drivers license. But one of those licenses will only be good in the issuing state. In fact, the ATF even tells you how to fill out the form 4473 correctly for those cases where you live in more than one state.

Then there is the fact that what he tried to do is a 1/4 million dollar fine and a 10 year prison sentence... under current law ...

Coincidentally, in March I bought 3 new weapons retail here in Las Vegas, Nevada where I am a resident with a valid drivers license and CCW...

AND not one single background check took less than 45 minutes for the stinking phone call alone... (3 unique instances/separate days and weeks)

    Notwithstanding...
The NICS system and its associated form 4473 has been proven over & over to be back door registration... Which in the history of the world has ALWAYS led to CONFISCATION...

Universal Background Checks = Universal Firearm, Magazine and Ammo Tax & Confiscation... the Ultimate Goal...

At the recent 2014 FBI budget hearings on CSPAN Director Mueller stated some sobering information...
    1. last year the FBI spent over 100 Billion tax payer Dollars doing background checks... and IF CONGRESS or the States intend to increase the burden on the FBI as they clearly are trying to do his budget will have to be increased EXPONENTIALLY... (Clearly with Congress currently upside down spending us into a 3rd word country; borrowing 4 billion a day plus interest from China and a National Debt.of over 16 Trillion and unfunded liabilities already at over 122 Trillion and counting; and no viable plan to EVER PAY OFF THE NATIONAL DEBT; this like other wasteful spending is unsustainable.)
    2. Director Mueller had no idea what happens with any form 4473 rejections, despite the fact that its currently with no new laws a 10 year prison & a 250,000 two hundred fifty thousand dollar fine for such an infraction... its no wonder there has been virtually negligible prosecutions under the current laws...

Yet Gun Ban Obama & Company want more Gun Control and Universal Background Checks and stiffer penalties to stop so-called Gun Trafficking ... the only gun trafficking going is being sanctioned by the Federal Government, and the BATFE... they don't enforce the fricking laws that are already on the books...

Notwithstanding, ZERO Accountability for the FBI & BATFE Form 4473 Abuse and zero affordable recourse for a law-abiding u.s. citizen, including but not limited to licensed dealers...
Gun Owners of America: Gun Owners of America and the National Rifle Association: NRA-PVF | PVF Home

Have brought this to the attention of Congress & the BATFE & FBI numerous times only to be met with "SUE US" as the response...

The Second Amendment like the first does not create/grant any right whatsoever... they both protect fundamental, pre-existing rights we were all born with...

Where does it say ... "Shall Not Be Infringed"... Except anything? Let alone you only have the right to defend yourself with a government approved shotgun as long as you are in your own home?
    How ludicrous a notion...

How quickly we forget the key tenet of the Second Amendment... As Thomas Jefferson, Alexander Hamilton, George Mason and others so clearly delineated: That WE THE PEOPLE retain the ability to REMOVE or REPLACE a TYRANNICAL GOVERNMENT...

Before the 14th Amendment there were 2 only & only two Amendments in the bill of rights that had a EXCEPTION clause, that could be clarified by Congress, States or the Courts...

    The 3rd & the 5th...

    E.G.:
3rd Amendment - No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law.

5th Amendment - No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation
