    There was not any kind of medical or mental health professional for Mr. Lewis involved. Here is a statement issued again tonight from one of Tresmond's legal team members :

    "The state discovered David Lewis by illegally searching the prescription drug database. They did not even wait for subpoenas. We have confirmed already that they have been looking through prescription records."

    Why was he singled out? There are tens of thousands of permit holders on antidepressants, pain killers and antianxiety meds. Why only him?

    Tresmond is handling two cases and isn't sure how many other cases exist in the state (anecdotal). With over 1 million CCW permits in NYS and only two people revoked this is hardly a pattern. Something else is going on here.

    The official statement from the NYS police...
    .
    “The SAFE Act requires mental health professionals to file notification when a medical professional determines that an individual he or she is treating is at risk to themselves or others. Medical prescription records are strictly private and not shared with the state, and no firearm license would ever be revoked for an anti-anxiety prescription.”

    “The notification forwarded to the Erie County Clerk’s Office required additional follow-up before a positive identification of a person at risk to themselves or others became final. The State Police was very clear in its letter to the Clerk’s Office regarding the need for due diligence and the need for a positive identification by the County before they removed any weapon.”

    “The final determination on whether to revoke or suspend a pistol permit license rests solely with the County and the licensing officials. The State Police has no authority to suspend or revoke a pistol permit in these circumstances.”

    Apparently, this moron Judge Boller (long history of anti-gun acts) moved on the permit despite the state being clear in its letter to the judge to do more due diligence before removing any weapon. I'm still not clear on why these two people were targeted. They didn't just pick a few names out of a hat. What precipitated this act? Who alerted the police to a problem? There is much missing here.

    But here's the rub... under this plan no LEO who currently or previously took medication for anxiety or depression should be allowed to carry a firearm and as a result must be dismissed from the police agency for disability. The same should hold true for CPS personnel, probation/parole officers, court officers, armed transport and prison guards, district attorneys and their investigators... should I go on? It's either all or none. Cuomo can't have it both ways. Another classless move by Cuomo without thinking-through the ramifications to the state itself. I personally know several LEO and people in the DA's office who currently take psychotropic medications (SSRI's / antianxiety meds) and smoke weed. I guess they won't have a career anymore. Oh well, there's always barber school.

    Sadly not a single major media outlet. An AM radio station, and a site for people interested in guns.

    Sadly it's not snowballing and I would not doubt that NY media under the suggestion of Cuomo and Bloomberg it will never gain traction in the major news outlets in NY.

    There sure is a lot missing here. One glaring item in all this is the county that is in the spotlight (for now), Erie. Last week there was another development in Erie County that has not shown up elsewhere. Tresmond released this statement on the 14th :

    "Some physicians in psychiatric practice in Western New York have been subpoenaed to release their entire patient files to the state for governmental review. This is no longer a gun issue. We are now squarely in fourth amendment territory; much scarier and far more dangerous than sole second amendment problems."

    The obvious problem here is that there is no legal way to subpoena all records for all patients of anyone, let alone an entire county. HIPAA requires specific releases or specific reasons to look at an individual patient. This type of universal subpoena is a violation of the Fourth Amendment. The Tresmond Law Firm is located in Erie County, and they were alerted to this by local medical practices. Now the question is, have other counties been subpoenaed ? Is NYS only after Erie County residents ? Anything going on in the other 61 counties?

    Here's another interesting twist in this dog's breakfast (a.k.a. SAFE Act). When the SAFE Act was passed it also added a new section to the state Mental Hygiene Law, Section 9.46. When a mental health professional believes someone in their care may be a danger to self or others, the caregiver is required to contact the Director of Community Service. If they agree there is a danger, the Director of Community Service passes their recommendation on to the Division of Criminal Justice Services, which includes State Police. But it remains a mystery how State Police received information that David Lewis could be a danger. No agency even knows who the Director of Community Service is.

    Since Lewis's doctor said he never contacted anyone with regard to his patient, how did the NYSP acquire his medical records ?

    What a smart idea! So now people is NY can either not get medical help and keep their guns or get their pills and loose them. How very very smart.

    And anxiety or depression are hardly clear cases for when people should not be allowed to own guns.

    I just heard an interesting aside to all of this.
    The question came up that if the Boston Bomber was on a list supplied by the Russians could the FBI alert the neighbors, kind of like a "sex offender list". The answer was no because of privacy concerns.

    Think about it.
    Just another example of discrimination against weapon choice.
    I mean there is no discrimination against Race, Creed, Color, Religion, Gender or Gender choice, but weapon choice is open season baby.

    It went out more than 20 years ago really. The letter that was taped to my dash after Andrew stated point blank to law enforcement, National Guard, and military that my personal vehicle was considered an emergency vehicle and not to be subjected to searches, nor to be detained. Regular vehicles were regularly being searched and detained. And people being arrested for just trying to get home from their jobs or shopping.
