Regarding the DA's decision it is perfectly within his power to refuse prosecution. Charges are dismissed every day all over America in the interest of justice. If the prosecutor doesn't feel he can get a conviction he has every right to dismiss charges. Very hard to get a unanimous jury to punish a CCW holder for this. Also, only takes one CCW holder to hang the jury. About 1 in 10 NYS residents has a CCW permit so a jury would surely contain permit holders. Jury nullification... just like OJ.
Excellent points. I was very pleased to read that the DA will not pursue this. It in itself is a terrifying reality in NY. The SAFE Act is testament to tyranny and we are hopeful the courts will overturn it.
