    First Arrest in NY For Magazine Law Man Had 9 Rounds in Magazine not 7 #safeact #guns

    "According to News10.com, a man in NY has become the first victim of New York’s draconian new gun laws. One of which forbids someone from loading more than 7 rounds into a gun magazine, even if it can hold more. The gun in questions was a a Smith and Wesson semi-automatic .40 caliber handgun, which police say was legally possessed. The man was also driving under a suspended license."

    He was charged with Unlawful Possession of Certain Ammunition Feeding Devices and Aggravated Unlicensed Operation of a Motor Vehicle 3rd Degree, both misdemeanors.

    Regarding the DA's decision it is perfectly within his power to refuse prosecution. Charges are dismissed every day all over America in the interest of justice. If the prosecutor doesn't feel he can get a conviction he has every right to dismiss charges. Very hard to get a unanimous jury to punish a CCW holder for this. Also, only takes one CCW holder to hang the jury. About 1 in 10 NYS residents has a CCW permit so a jury would surely contain permit holders. Jury nullification... just like OJ.
