    Under the latest changes of the so-called Castle Doctrine, state lawmakers agree “people have a right to defend themselves and third parties from physical harm and crime.” Rather than excluding officers of the law, however, any public servant is now subject to be met with deadly force if they unlawfully enter private property without clear justification.

    Believe it or not, NYS allows this as well. Article 35 of penal law doesn't allow use of force against a public servant who is effecting an arrest but NYS case law shows repeatedly that verdits were overturned. Take the case of Raymond Zayas. LE called by a neighbor for a loud DV incident at his house. LE shows up and starts hammering the door-in without any warning or announcing themselves. Zayas shoots the LEO through the door causing significant injury. He was a convicted felon who possessed his gun illegally. The conviction was overturned on appeal because penal law article 265 prohibits the charge of criminal possession of a weapon by anyone in their own home and because the jury wasn't correctly instructed that under article 35 he may make the shot through the door to thwart a burglary... see NYS PL S35.20.
