    Imagine a judicial candidate that is so far to the left that even Obama's Chief of Staff, Rahm Emmanuel, is hesitant to push him forward.

    Imagine a liberal law professor that not only fails to meet the ABA's basic requirements for a federal judge, but is so green behind the ears that it appears the only reason he is being nominated to the federal courts is because he served as part of President Obama's transition team.

    If you can imagine such a leftist candidate, then you would be thinking of Goodwin Liu, the President's recent nominee for the U.S. Court of Appeals for the Ninth Circuit.

    Liu is the Associate Dean and Professor of Law at the ultra-left UC Berkeley School of Law. Only 39 years old, he comes nowhere near fulfilling the ABA's standards for a judge.

    But what he lacks in experience, he makes up for in radical liberalism. In a recent book that he co-authored, Liu says that, "Applications of constitutional text and principles must be open to adaptation and change... as the conditions and norms of our society become ever more distant from those of the Founding generation."

    Got it? Like many radical progressives, Liu believes that our rights are constantly evolving. The Second Amendment might have been necessary in the 1700s, he believes, but now those rights are no longer necessary.

    In Liu's world, there would be no gun rights

    Noted author David Kopel cites a law journal article of Liu's where he criticizes the Supreme Court for declaring two gun control laws as unconstitutional -- the Brady Law's unfunded mandate and the Gun-Free School Zones Act.

    Liu said that Supreme Court cases like these did "damage" to civil rights and "upset settled understandings of congressional power." What?! Striking down gun control laws does damage to civil rights? Well, let's be clear: the Court did upset someone's "settled" understanding of things, but it was the LIBERAL'S misunderstanding of the Constitution.

    By the way, Liu co-authored the 2002 law journal article with then-Senator Hillary Clinton... which should tell us all we need to know about Liu's liberal, anti-gun views!

    Rights evolve over time?

    The bottom line is that Liu would not be a stickler for the Constitution if he were to sit on the appellate court.

    "It becomes pretty clear why 'originalism' and 'strict construction' don't make a lot of sense," Liu said in an interview promoting his book. "The Framers deliberately chose... broad words so they would be adaptable to new challenges over time."

    No wonder that the ranking Republican member of the Senate Judiciary Committee, Jeff Sessions (R-AL), spoke out so forcefully against the nomination of Goodwin Liu:
    I am very disappointed by President Obama's nomination of Professor Goodwin Liu to the U.S. Court of Appeals for the Ninth Circuit....

    Instead of nominating an individual who has demonstrated an impartial commitment to following the Constitution and the rule of law, President Obama has selected someone far outside the mainstream of American jurisprudence. Professor Liu believes that judges should look to "evolving norms and social understandings" in interpreting the Constitution, he has a history of advocating for racial preferences, and he served on the Board of the directors of the ACLU.

    Breached by unknown hackers over 300 times, Grossly incomplete and severely flawed error-riddled registry
    The figure being bandied about in the media is that police are now up to 11,000 “uses” of the registry per DAY, (not year.) This is a phony, contrived figure by creating a computer generated “hit” for every conceivable clerical use of police computers, from traffic tickets to minor misdemeanor records, even jaywalking or someone calling police about a noisy party next door, which automatically generates an address check through the porous CFC database. As well, every
    legal sale of a firearm either by a retailer or person to person, generates up to five or more hits on the registry. Police have admitted it has been breached by unknown hackers over 300 times. CPIC (Canadian Police Information Center) has been admittedly breached some 1,400 times up to 1995. How many times has it been accessed by the tens of thousands who have unrestricted access to it? Are they all honest? If you google “police officer charged”, you will get over eight million responses! Does this make you feel more secure? Thefts of gun collections, and responsibly owned firearms, previously very privately held, have increased exponentially since the registry came into being. Law abiding people were forced under threat of jail to have them and their most private information, filed in the “shopping list for criminals.”
    Few hits are actual “firearms” inquiries especially since front line police would be very unwise to even think of relying on it.

    Last week we reported that the U.S. House of Representatives was preparing to consider H.R. 157, the "District of Columbia Voting Rights Act," which proposes to give the nation's 30th most populous city a vote on the House floor.

    This week, the bill was pulled from consideration over the refusal of D.C. Delegate Eleanor Holmes Norton to agree to common-sense reforms to D.C.'s gun laws, which would have brought the District into compliance with the historic Heller decision.

    The tone of the anti-gunners' rhetoric was predictable. "The District should not have to cede one set of rights for another," the Washington Post complained. "A person in the District would be able to walk on the streets carrying an assault weapon slung over her shoulder or with concealed weapons," cried Del. Norton (of course, the legislation would do no such thing). Sen. Dianne Feinstein (D-Calif.) resorted to cliché, commenting that if D.C.'s gun laws are reformed, "I believe the District will become much less safe," to which we are tempted to ask, "less safe than where?"

    Predictably, Norton and her supporters expressed their intention to regroup and try again. "I am full of promising ideas about how to move forward," Norton said. "We will persist in our mission to realize voting rights, local autonomy and statehood for D.C.," proclaimed the "D.C. Vote" organization. "Giving up on gun control could be a good deal if the District were getting two Senate seats as well," a columnist in the Washington Post mused.

    But Rep. Travis Childers (D-Miss.), author of the reforms to D.C.'s gun control restrictions, intends to complete his mission too. "This fight is not over," he said. "When, nearly two years ago, D.C.'s City Council defied a Supreme Court ruling to protect citizens' right to [keep and] bear arms, it violated the fundamental rights upon which this great country was founded. I remain committed to overturning D.C.'s gun ban—a critical step towards ensuring that these rights are permanently safeguarded for all Americans. I plan to move forward with introducing this important bipartisan legislation in the near future, and will urge leadership to bring our bill to the floor without delay."

    Barrack Obama is legally qualified to be the President of the United States of America.
    So far, I have not seen anything coming directly from Barry regarding gun control. Just a few words from his liberal minions.
    Perhaps we should just wait and see.

    On December 7, 2007, the Jr. Senator from Illinois Barack Obama introduced the Senate version of the Global Poverty Act of 2007 (S.2433). On February 13, the bill cleared the Senate Committee on Foreign Relations, on which Obama and 6 (Biden, Dodd, Feingold, Hagel, Lugar, Menendez) of the bill's 9 co-sponsors serve. The House version of the bill (H.R.1302) passed by a unanimous voice vote last September 25.

    (Following the European Socialist Model Obama is so fond of) ... Air guns are finally to be licensed in Scotland under a new pilot announced by ministers yesterday.

    Kenny MacAskill, the Justice Secretary, told the annual conference of the Association of Scottish Police Superintendents in Dunblane that new air rifles or pistols would be subject to a licensing scheme.
    Firearms have traditionally been a reserved matter, but the Scottish Government has pushed for years for the power to tighten regulations on the issue.
    The recent Calman Commission recommended that the powers on air weapons be transferred to the Scottish Parliament and the new UK Government has said it will implement the recommendations in full.
    The move follows the death of two-year-old Andrew Morton, killed five years ago with an airgun pellet shot by Mark Bonini, 27, in Glasgow’s east end.
    Three Scots have died and more than 1100 have been injured by airguns in the last 10 years.
    Bonini was jailed for at least 13 years and since then UK legislation on air weapons has been tightened. The minimum age for owning an airgun has risen from 17 to 18, mail-order sales have been banned and all retailers must now be registered.
    However, Scottish ministers and police believe Scotland still needs to do more to tackle the country’s problems with air weapons.
    MacAskill said: “We will establish a Scottish Firearms Consultative Panel. One of the objectives of the panel will be to look at establishing a pilot licensing scheme for air weapons. This will enable us to test the practicalities of air weapon licensing.
    “It will also test whether or not a licensing system can operate effectively without wider reform of the firearms legislation.
    “While our primary concern is for public safety, we are clear that any licensing system must be workable for the police and all involved.
    “This includes looking at the funding issues. We will work closely with the Consultative Panel to ensure this is the case.
    “We have a problem with air weapons in Scotland that needs to be tackled. The pilot will be for new sales of air weapons rather than those languishing in people’s lofts.”
    MacAskill’s previous call for a summit aimed at reforming gun legislation was rejected by former Home Secretary Jacqui Smith, who said it was “not timely” and repeated requests for airgun licensing to be devolved were rebutted by the previous UK Government.
    MacAskill yesterday also announced £300,000 in funding for police forces to roll out the Tayside pilot project allowing, in specific cases where a risk was posed to children, the disclosure of sex offender details.
    And he said he would look at concerns raised by the superintendents about the need to increase the traditional six-hour detention period for suspects if they were unable to be questioned due to drink or drugs.
    In relation to calls for an extension to the six-hour detention period, MacAskill said: “It is in all of our interests to ensure that the police have at their disposal robust procedures which enable them to investigate crime effectively.
    “Where changes are needed, changes will be made. I do not view these matters as ideological but operational. If officers need powers on DNA, detention or whatever then we are happy to consider them and do what’s right.”
    MacAskill continued: “We are happy to look at this with the Crown and defence lawyers.
    “It is common sense that if someone is blind drunk they are not capable of being interviewed. There is something perverse about the idea of someone sobering up after five hours 55 minutes and then being released. The obligation of government is to try to find a solution and that is what we will seek to do.”...

    Fresh from his efforts to seize government control of the health services sector (ObamaCare) and the financial markets ("finance reform"), Barack Obama has a new priority: silence his political opposition.

    As satisfying as it was for Obama to seize control of one-sixth of the economy, he has had to suffer protest from the "little people" (like us). So he is pushing the Orwellian "DISCLOSE" bill (HR 5175) to make sure gun groups and other pro-freedom forces cannot mobilize their members in the upcoming elections.

    When Obama says "disclose," what he really means is "disclose gun group membership lists"

    Not surprisingly, these efforts to shut down free speech don't apply to Obama allies, like Democratic-leaning labor unions. They only apply to groups which are not reliable Obama allies, like Gun Owners of America.

    But, for those groups whose free speech is targeted for Obama's wrath under this bill, the consequences are severe:

    * Under Title II of the bill, GOA (and other groups, as well as many bloggers) who merely mention public officials within 60 days of an election could be required to file onerous disclosures -- potentially including their membership lists.

    * Also under Title II, GOA could be required to spend as much as half of the time of a 30-second ad on government-written disclosures.

    * In addition, Sections 201 through 203 would potentially put the government's snooping eyes on any American who voices a political opinion, despite the fact that the Supreme Court, in Buckley v. Valeo, declared that Americans have a right to voice their opinion to an unlimited extent, if unconnected with a political campaign.

    Here's an idea: If Obama is so irritated at the Supreme Court's defense of political free speech by groups like GOA, why doesn't he apply his sleazy new rules to his political allies, as well?

    ACTION: Please urge your congressman to vote against the anti-gun HR 5175. This bill has moved out of committee and has now been placed on the House calendar.

    RINO Gun Banning Mayor Michael Bloomberg At It Again...

    What Do They Put in the Water?

    When a New York City mayor does something goofy, a normal reaction is: “there they go again.” When another mayor does the same thing years later, an additional thought comes to mind. Namely, “what do they put in the water there?”
    In the early 90s when Mayor David Dinkins was in office, a Utah tourist was murdered by a knife-wielding assailant. The next day,Mayor Dinkins held a news conference saying that the previous day’s violence meant that additional gun control was needed in New York.
    Fast forward to the wannabe car bomber who through no thanks to the authorities failed to carry out his murderous mission. The following week, Mayor Michael Bloomberg went to Washington to testify for a horrendous bill sponsored by that enemy of freedom, NJ’s Sen. Frank Lautenberg. The bill? A gun control bill.
    Speaking at the hearing, Bloomberg said: “It is imperative that Congress close this terror gap in our gun laws -- and close it quickly. The car bomb the NYPD found in Times Square on Saturday night was not the only attempted terrorist attack on our city since9/11 -- far from it. And sadly, it won’t be the last.”
    Hmm, so let’s have some more gun control because there was a car bomb in New York City. Talk about a non starter.
    But wait, it does not seem to be just New York mayors who are loony.Congressional Democrats had the same reaction to the bombing of the Oklahoma City federal building. Maybe we need to understand that for the citizen disarmament supporters, any excuse is a good excuse to grab the sovereign people’s guns.
    In Bloomberg’s case, he was after a lot more than disarmament. The bill he supports also aims at one of the most important bulwarks of liberty, namely, due process. Lautenberg wants to enable the faceless maintainers of the Terrorist Watch List to use the list to deny gun sales to anyone they choose.
    No one ever gets to face their accuser when it comes to the Terrorist Watch List. Nameless trolls in law enforcement agencies can add any name they want. Otherwise, how else to explain the addition of the late Sen. Edward Kennedy to the list? There is no way to get off the list (unless, like Sen. Kennedy, you can call the head of the Homeland Insecurity Agency).
    Seeing how ruthless the Chicago-style political thuggery of the Obama administration is, it is not hard to imagine that all their political enemies would end up on the Watch List. In September, 2008, Secretary Janet Napolitano announced that she had zeroed in on the terrorist threat in the U.S. by releasing a publication entitled: Right wing Extremism: Current Economic and Political Climate Fueling Resurgence in Radicalization and Recruitment. The resurgence threat, of course,comes from returning veterans, pro-lifers, Second Amendment advocates and constitutionalists in general, the report explained. Police were to approach such people with extra precautions.
    Not once has the Obama gang issued an analysis of the 1400 years of Islamic terror and conquest and its contemporary threat posed by jihadi thugs. Mayor Bloomberg’s speculation about who the wannabe car bomber might be before he was apprehended and confessed suggested that we would probably find that he was a 40-year old loner white guy who did not like ObamaCare. Oops, Faisal Shahzad is a 30-something naturalized Pakistani Muslim extremist. And, double oops, he made over a dozen trips to be trained by the Pakistani Taliban who have praised his attempt.
    While the Beltway Sniper murders were taking place, you may recall that police were looking for a 40-something white guy and a loner.How disappointing for the politically correct that it was a couple of black guys who had trained at a Muslim jihad camp in southwestern Virginia.
    The domestic gun control advocate has always had a love for appeasement at home and abroad. No guns for self-defense, and no resistance to jihadi murderers. As Governor of Arizona, Janet Napolitano declared that there was no border problem in her state.Where does she think the real problem lies? Well, it’s those angry Tea Party types, of course!
    A related item suggests that Secretary Napolitano has imposed an affirmative action program for the entire Department of Homeland and security. Namely, all key personnel must be as vision challenged(we used to say blind) as is the Secretary. Faisal Shahzad was on the terrorist watch list while he was being naturalized. I bet if they found a membership card for Gun Owners of America he would not have been naturalized.
    Let’s say it. Sen. Lautenberg and Mayor Bloomberg and the like are far more interested in depriving citizens of the means of self-defense than they are in effective counter-terrorism measures.
