What States Have Red Flag Laws?

What States Have Red Flag Laws?

    Last updated: 06/21/2019

The rise of “red flag” laws across the country has become a point of concern among America’s veterans. As we have covered previously, a red flag law is a gun-violence protection law that allows law enforcement and families to petition courts to remove firearms from a person who may present a danger to themselves or others. Rather than requiring probable cause that someone has committed a crime, red flag laws are based on the supposition that a crime could occur based on the subject in question.

For example, a veteran suffering from PTSD could have their legally owned firearms confiscated under a state red flag law under the supposition that their mental health condition makes them unfit to own a gun.

So far, 16 states have implemented some form of red flag legislation.

    Florida
    New York
    Delaware
    Illinois
    Maryland
    Massachusetts
    New Jersey
    Rhode Island
    Vermont
    California
    Connecticut
    Indiana
    Oregon
    Washington
    Colorado (April 2019)
    Nevada (June 2019)

In addition to those states, the following states have had red flag legislation introduced in their state legislatures.
    Alaska
    Maine
    New Hampshire
    Minnesota
    Michigan
    Iowa
    Ohio
    Pennsylvania
    Nebraska
    Missouri
    Arizona
    Kansas
    Arkansas
    Tennessee
    North Carolina
    South Carolina
    Oklahoma
    Texas
    Hawaii

While common sense gun control measures can be agreed upon by people on all sides, we must be very careful when it comes to rescinding 2nd Amendment rights without due process of the law. No doubt, red flag laws will continue to be a major topic of debate in the United States in the years to come.

    My Thoughts:

The basic premise for these Red Flag Laws is good overall on the face of it, but without the person being accused being able to rebut these claims in court prior to them being implemented, the chance’s for them being misused to the person that’s being accused is overwhelming.

While I can find hundreds of articles showing that Red Flag Laws are a legal, moral, and physical disaster waiting to happen, we need to catalog actual cases showing where these disasters actually happened, like here:

    www ammoland com 2018 11 maryland-red-flag-gun-confiscation-order-ends-with-dead-gun-owner
    From the article:
Ferndale, Maryland –-(Ammoland.com)- At 5:17 AM on Monday, November 5th, 2018 an Anne Arundel County, Maryland man was shot and killed in his home by police as they tried to carry out a “Red Flag Gun Confiscation Order.”

Red flag laws give the police the right to confiscate firearms from a person without due process through something called an extreme risk protection order. All it takes for a judge to issue an extreme risk protection order is one person stating that the subject is a danger to themselves or others.

With extreme risk protection orders, authorities do not give the accused a chance to rebuke the charges before a judge issues the order to take the accused person’s firearms.

We had better be VERY CAREFUL when everyone and the "MSM" is talking Red Flag Laws. Mental health, mental illness, mental disorder, etc., as the answer to school shooters & gun control. This is a very slippery slope, another way to skirt around the 2nd amendment especially pertaining to confiscation. Just who is to determine who suffers from a mental disorder, your neighbor, ex-wife /husband, Hillary Clinton, Joy Behar? I believe that this mental health issue is a TROJAN HORSE!!!

Considering Cuomo threatened that man with physical harm, he just might be considered a candidate for a Red Flag action.

    And you know it.

WOW, really, you are willing to lower the bar that low? Call someone a name use "bad words" and get your guns taken away. That is one slippery slope you are starting down.

Threatening to "throw someone down the stairs" or "kick their ass" is NOT ground for removing someone guns. I'm sure you have made similiar comments to others in your day, or you really are a sniveling little coward.

Don't you ******* dare tell anyone here you are a defender of the 2A, coward.

Yeah, but he is a liberal, and that gives him a free pass to threaten violence, or tell others to act violently.

The only thing I don't understand is:
what is this about Hannity sticking up for him?
