    More than 100 Virginia cities, counties declare themselves gun sanctuaries as Dems prepare to take legislature

    Dozens of Virginia counties and cities are declaring themselves Second Amendment sanctuaries in an apparent revolt against the state legislature's proposals for new firearm restrictions.

    The movement has gained so much steam that Virginia Attorney General Mark Herring issued an advisory opinion reminding residents that such "sanctuary" resolutions had no standing.

    "It is my opinion that these resolutions have no legal effect," Herring said in a letter issued Friday. "It is my further opinion that localities and local constitutional officers cannot nullify state laws and must comply with gun violence prevention measures that the General Assembly may enact."

    The Associated Press reports that more than 100 cities, towns and counties have passed such resolutions.

    The controversy came just before Democrats take control of both the Virginia Senate and House of Delegates for the first time since 1996. Gov. Ralph Northam already pledged to pass "common-sense gun safety legislation" after the November election.

    The new General Assembly is expected to vote on two bills in particular -- SB 18 and SB 16 -- which would ban assault weapons, raise the minimum age of purchase to 21 and require background checks for any firearm transfer.

    "It's just the invasion of someone's personal rights," Jim Wood, owner of a Staunton gun shop, told WHSV.

    Wood told the Harrisonburg outlet that the Second Amendment "plainly states that we're allowed to bear arms."

    "When they start picking apart at it, then all of a sudden it becomes the anti-gun laws that they've had in other countries," he said.

    The Virginia Citizens Defense League (VCDL), a gun-rights group that provides a model resolution, claims that 85 of Virginia's 95 counties have already approved so-called sanctuary measures. At least nine cities and 17 towns have done the same, the group said.

    The group is also planning a protest for Jan. 20 on the steps of the Capitol. VCDL has posted pictures purportedly showing packed crowds at boards of supervisors meetings in more than a dozen localities.

    The resistance has also reached law enforcement. Culpeper County Sheriff Scott Jenkins has already vowed to deputize citizens if Democrats pass gun control.

    On Wednesday, VCDL posted a video showing a rapid increase in sanctuary resolutions since November, when Democrats won their majority in the state's General Assembly.

    Localities across the United States -- including Florida, California, New Mexico and Washington -- have passed or considered similar measures.

    VIRGINIA SHERIFF VOWS DEPUTIZE RESIDENTS IN RESPONSE TO DEMOCRATS' GUN LEGISLATION

    VCDL's model resolution refers to a number of Constitutional provisions and Supreme Court decisions before calling out the potential for gun restrictions in Virginia.

    "Certain legislation that has or may be introduced in the Virginia General Assembly, and certain legislation which has or may be introduced in the United States Congress could have the effect of infringing on the rights of law-abiding citizens to keep and bear arms, as guaranteed by the Second Amendment to the United States Constitution and Article I, Section 13 of the Constitution of Virginia."

    Northam seemed unphased by the potential backlash in November. “I don’t think there’s anything to be afraid of," he said, according to The Virginian-Pilot.

    But according to VCDL President Phillip Van Cleave, Democrats have awakened a "sleeping giant." and "declared war on Virginia's gun owners," Van Cleave said.

    I just hope the Democratic people in Virginia realize that their idea of these laws aren’t going to go over well and could result in a lot of people getting hurt.

    Virginia on Edge as Democrats Threaten Gun Owners with Troops

    Following Virginia’s sweep towards liberalism during this year’s election, the state seems to now be hurtling towards potential conflict. And it’s all centered around the likely passage of stringent gun control laws, some which may include the banning of popular semi-automatic firearms. Most of the state’s counties are conservative, Second amendment supporting as a whole. Those counties are now at odds with the few liberal counties who want strong gun laws and bans.

    Democrats now hold power in both chambers, this has eliminated any conservative voices. The state’s Democrats want to now pursue an “assault weapons” ban, and a red flag laws. And they should have no issue succeeding.

    But at least 75 counties across the state are refusing to comply. Elected officials in these counties are calling themselves, “Second Amendment sanctuary counties,” a clear jab at immigration sanctuary counties that notoriously sprung up following the election of Donald Trump.

    In a Second Amendment sanctuary county, the sheriff’s office would not enforce the state’s gun laws.

    Now the state’s Democrats say they are ready to take action against these sheriffs.

    “I would hope they either resign in good conscience, because they cannot uphold the law which they are sworn to uphold, or they’re prosecuted for failure to fulfill their oath,” Democratic Virginia Rep. Gerry Connolly told the Washington Examiner of local county police who may refuse to enforce future gun control measures. “The law is the law. If that becomes the law, you don’t have a choice, not if you’re a sworn officer of the law.”

    Further threats include cutting off county funding and sending the National Guard into wage battle.

    “And ultimately, I’m not the governor, but the governor may have to nationalize the National Guard to enforce the law,” Democratic Virginia Rep. Donald McEachin said. “That’s his call, because I don’t know how serious these counties are and how severe the violations of law will be. But that’s obviously an option he has.”

    The threats of enforcement have many believing that Virginia could serve as the beginning of a burgeoning civil war. Ever since Hillary Clinton lost the Presidency to Donald Trump, the battle lines between liberals and conservatives have become more defined. Suggestions of civil war have ripened as many don’t see any way the two sides can work together.

    Democrats have notoriously refused to enforce immigration laws across the nation. They believe that not cooperating with ICE is not, in and of itself, illegal. But denying the enforcement of gun laws, according to the same Democrats, is illegal.

    If Democrats were to call in National Guard troops, what would such a climate look like? How many National Guard troops would refuse to perform these duties? And what happens when police or troops go door to door to confiscate guns?

    For many citizens, the idea of a civil war hardly feels like a conspiracy anymore. It’s becoming more and more a reality as our elected officials continue to over govern.

    What really pisses me off is the Democrats will allow immigrants to have their sanctuary security zones in VA.

    The anti Americans who call themselves Democrats in the state of Virginia are trying to illegally and immorally violate the 2nd Amendment of the US Constitution by infringing upon the right of the people to keep and bear arms. They even threaten to deploy the National Guard to enforce their illegal and immoral action. Really?

    Our 2nd Amendment protection was created at the founding of our country and now the Democrats want to violate it by force? OK, if that's the way they want it then the Trump Administration should respond in kind by announcing that any illegal force from the state of Virginia will be met with opposing force by the US Military who will protect the American people from enemies both foreign and domestic, in this case domestic.

    The anti Americans should get the message that their hatred for Americans' GOD given rights will not be tolerated.

    Virginia Governor Northam Increases Corrections Budget In Anticipation Of Jailing Gun Owners

    As if Virginia Gov. Ralph Northam’s wholesale attack on law-abiding gun owners wasn’t enough, the disgraced public official and his Michael Bloomberg-bought allies in the General Assembly now want the state’s hard-working taxpayers to foot the bill for their unconstitutional schemes. The budget bill (HB30) includes an appropriation of a quarter million dollars to carry out a host of gun control measures that Northam and his anti-gun allies hope to enact.

    The $250,000 is appropriated to the Corrections Special Reserve Fund in order to provide for the “increase in the operating cost of adult correctional facilities resulting from the enactment” of Northam’s gun control measures. Among the enumerated laws that this allocation is meant to fund is a ban on commonly-owned semi-automatic firearms, the criminalization of private firearms transfers, and gun confiscation orders issued without due process.

    Aside from the insult of forcing law-abiding Virginia taxpayers to pay for the diminution of their rights, the gun control allocation is a severe waste of resources. Northam’s Bloomberg-backed gun control measures will not make Virginia safer.

    In additional to being unconstitutional, a ban on commonly-owned semi-automatic firearms will not reduce violent crime.

    Long guns of any description are rarely used in violent crime. FBI Uniform Crime Reporting data breaks down homicides by weapon type. In 2018, the FBI reported that there were five times as many individuals listed as killed with “knives or cutting instruments,” than with rifles of any kind. The data also showed that rifles were listed as being used in less homicides than “blunt objects (clubs, hammers, etc.)” or “personal weapons (hands, fists, feet, etc.).”

    A 1997 Department of Justice-funded study of the 1994 federal “assault weapons” ban determined that “At best, the assault weapons ban can have only a limited effect on total gun murders, because the banned weapons and magazines were never involved in more than a modest fraction of all gun murders.” A 2004 follow-up Department of Justice-funded study came to a similar conclusion. The study determined that “AWs [assault weapons] and LCMs [large capacity magazines] were used in only a minority of gun crimes prior to the 1994 federal ban,” “relatively few attacks involve more than 10 shots fired,” and “the ban’s effects on gun violence are likely to be small at best and perhaps too small for reliable measurement.”

    So-called “universal” background checks do not stop criminals from obtaining firearms.

    Background checks don’t stop criminals from stealing firearms, getting them on the black market, or getting them from straw purchasers. According to the U.S. Department of Justice, 75 percent of criminals in state and federal state prison who had possessed a firearm during their offense acquired the firearm through theft, “Off the street/underground market,” or “from a family member or friend, or as a gift.” Less than one percent got firearms from dealers or non-dealers at gun shows. ATF has reported, “[t]he most frequent type of trafficking channel identified in ATF investigations is straw purchasing from federally licensed firearms dealers.”

    This year, researchers at the Bloomberg School of Public Health and the UC Davis School of Medicine found that comprehensive background checks and prohibitions based on violent misdemeanors “were not associated with changes in firearm suicide or homicide.”

    Aside from enabling the unacceptable deprivation of constitutional rights without due process, an Extreme Risk Protection Order (Red Flag) law is unnecessary in Virginia because the state already has strong and effective civil commitment laws.

    Under Virginia law, a law enforcement officer may take an individual into emergency custody for a mental health evaluation without prior court approval. A person detained in this manner is then evaluated to determine whether they meet the criteria for a temporary detention. A person that was subject to a temporary detention order and subsequently agreed to voluntary admission to a mental health facility is prohibited from possessing firearms until their rights are restored by a court.

    Tax-paying Virginians should not have to foot the bill for Northam and Bloomberg’s radical attack on their fundamental rights.

    A police officer can't lose his job for failing to enforce a law in conflict with the US Constitution.
    Marbury v. Madison,1803

    This Supreme Court already ruled on this. Legislatures can pass all the laws they want. However if they are in direct conflict with the United States Constitution they are null and void. Therefore no police officer is derelict by refusing to enforce an illegal order. Same for the military. If the order was unlawful in the first place there's no obligation to attempt to enforce it.
