OAKLAND, CA – A 77-year-old homeowner was arrested after shooting and killing a robbery suspect in East Oakland, prompting a legal review to determine whether the act was justified as self-defense.
The incident occurred just before 6 p.m. on Monday at the intersection of 98th Avenue and Burr Street. According to police, two men and a woman arrived at the residence in a stolen Infiniti Q40. A witness reported that the trio entered the property, with one of the men wielding a crowbar, before hearing a gunshot.
Police documents reveal that officers arrived at the scene to find the homeowner holding a stolen Colt Python revolver and pointing it at the female suspect. She informed the police that her friend had been shot by the homeowner. Despite efforts by Oakland firefighters and paramedics, the suspect died at the scene. The identity of the deceased has not been disclosed.
The third suspect was found at the scene carrying a replica gun and was arrested on suspicion of burglary.
As of now, no charges have been filed against the homeowner. He remains in custody while the Alameda County District Attorney’s Office reviews the case. Prosecutors have until Thursday to decide whether to charge the homeowner with murder or to rule the killing as an act of self-defense. The homeowner has declined to speak with investigators.
KTVU legal analyst Michael Cardoza commented on the situation, emphasizing the legal complexities involved. “You’re not supposed to chase them. If you chase them and shoot them, for example, in the back, that is unlawful,” Cardoza explained. However, he also noted that the homeowner could potentially argue self-defense if he believed he was in imminent danger.
“If you are in imminent fear of your life or someone else’s life in your home, you have every right to take necessary means for self-defense against the invaders,” Cardoza added.
The fact that the firearm was stolen adds complexity to the case, potentially leading to additional charges against the homeowner. While the presence of the crowbar and the aggressive actions of the suspects might suggest a clear case of self-defense, the stolen gun and the circumstances of the shooting will play a critical role in the DA’s decision.
