NEW ORLEANS, LA — A New Orleans homeowner shot and killed a man who was trying to break into his house shortly before 7 a.m. Friday, and by that afternoon the New Orleans Police Department had already said he will not be charged.

Officers responded to the 1400 block of Harrison Avenue on the morning of Oct. 2 and found a man with a gunshot wound, as reported by WVUE. New Orleans EMS later pronounced him dead. The New Orleans Coroner identified him as 29-year-old Tyree Parker.

On Friday afternoon, NOPD officials confirmed the man who fired did so because Parker was trying to break into his house. Officers believe he was defending himself and others during the incident, police said. The homeowner is cooperating with officers and will not face charges.

That is the entire public record so far, and it is thin. Police have not said whether Parker was armed, how he tried to get in, or who else was inside. The homeowner has not been named. What NOPD has said is narrow and specific: a man was trying to force his way into an occupied house, the man inside fired, and officers believe he was defending himself and the other people there.

The hour matters. Shortly before 7 a.m. is when people are home, and a man working to get through the door of a house with people inside is a threat to the people, not to the drywall. Deadly force is only ever about an imminent threat of death or serious bodily harm to a person, and that is exactly the way NOPD framed what its officers believe happened here. The department did not describe a burglary. It described a man defending himself and others.

The homeowner’s conduct afterward is the other piece. He is cooperating with officers. That cooperation is a large part of why a department could say, within hours, that it believes he was defending himself and that it does not intend to charge him. Investigators had a willing account from the man who fired instead of a stranger to track down, and that shapes the charging decision as much as the facts of the fight do.
